Is the I-864 necessary for AOS?

My husband and I are currently filling out the paperwork for my AOS. We got married a week ago :D I was just wondering about the following. The list of AOS forms in the downloads section includes the I-864 affidavit of support. Is this a form that has to be filled out and included with the paperwork, even if we already filled out the exact same form form for the visa procedure and so it is in my file? That just doesn't make sense. We will fill it out again if we have to, but it would save us some time if we didn't ;)

Hi there. I applied AOS based from K1 visa too. ANd I-864 is the one needed for AOS. As I can remember the I-134 is the one that we filed during the K-1 fiancee visa. Are you sure that you already used I-864 before? just clarifying :whistle:

Dec 17, 2008---WELCOME NOTICE RECEIVED

Jan 9, 2009---CARD RECEIVED FINALLY! Approval date 12-10-08..expires on 12-10-10

You filed I-34 with your K-1 Visa application. I-845 is required when you file for AOS .

THat's what I'm trying to ask her. I know this because I get confused with these two forms too when we're gathering the forms for AOS. So again, are you sure you used I-864 before? :unsure:

Yep....for the visa, you filed with the Embassy. Now it's the USCIS....which doesn't have a copy of what you filed before.

You cannot adjust status without a sponsor, Spouse MUST sponsor, and MUST provide an I-864.

IT IS REQUIRED.

Only exception would be if the person adjusting status had lived and worked in the USA and were credited with 40 quarters of work.

I got confused because the forms look so much alike. It was indeed the I-34 we filed before. Looks like my husband will have to fill out some more forms before we're done ;) Thanks for clearing this up anyway :thumbs:
