Hi,

My husband is planning a trip home but it will most likely be while his I-751 is pending. Is it possible to travel when his conditional greencard is expired and his I-751 is pending? Will he need to have his passport stamped by USCIS indicating that he has filed to remove conditions? What documentation is needed for him to travel if his GC is expired?

Yes, you can travel during this period. Make an InfoPass appointment and bring all of your I-751 stuff with you and your itinerary if you have it. They will give you the I-551 stamp in your passport. My husband traveled countless times during the I-751 process and is now traveling on a stamp because USCIS gave him the wrong birthdate which was discovered 8 months after the GC was issued. My husband's primary work involves traveling from the US to Europe.

The only word of caution I will make is to allow yourself a minimum of 3 hours connection time for when you arrive back into the US. Because these stamps are frequently forged (according to the Immigration folks at the POE) your husband can most definitely expect to go to Secondary Inspections for stamp verification. My husband has come in mostly to Washington Dulles, but he has also arrived via Chicago and last night through Boston, and each time he went to Secondary Inspections (or the "bad boys' room" as my husband calls it).

I-751 NOA1 letter will extend green-card by 1 year, you use the expired GC and the NOA1 letter to re-enter the USA, no need for a stamp in passport.

This is a very common subject.

You will receive a notice of receipt for the form stating that "Your alien card is extended one year - employment and travel authorized". Keep the receipt with your green card. If by some chance you are not approved within a year you will want to make an InfoPass appointment to go to your Local Office to request an I-551 stamp in your passport. This does happen as it sometimes it takes over a year to be approved. After your NOA extension expires, this is your only evidence of legal status which you are required to have, by law. This happens occasionally, that a case takes over a year, but it's rare. Local Offices will not give an I-551 stamp is you have another type of evidence of status (ie, expired Green Card + extension letter).

I plan to get an I-551 stamp, too.

Just wonder do I have to bring 2 photos to get that stamp,

or all I need is my valid passport and expired GC?

My return trip will enter the US via Lax in late Oct., any thought about this airport?

No need for photographs - just your unexpired passport and your expired or soon to expire green card. They look up your file with your A#.

I didnt get the stamp in my passport but I did bring my original NOA. I left the country after the NOA1 was received and will be coming back in about 2 weeks through LAX.

I will have 8 hours layover (not my choice and not on purpose); should I be expecting any problems? Should I go to the American Embassy/Consulate here in NZ and try to get a stamp?

Please any advice is welcomed!

Yes, I used my NOA1 letter (and I didn't have the stamp) twice and did not have any troubles at all. The American consulate in NZ will probably not be able to give you the stamp anyways.

they won't tell you anything different than what you have read in this thread. If you are nervous, make the infopass and ask for the stamp, they should give it to you.

The USCIS and my attorney suggest it is not necssary to get the stamp unless you did not get the NOA. I am travelling too and was worried, but I was told it's not a big deal... they may just take you aside to verify your info... So I will bring everything with me just to make sure!

I have traveled recently using my expired GC and NOA; had no problems whatsoever at POE, was not asked any questions, was not taken aside for further verification, processing took approximately two minutes.

US Citizen since August 09.

I travelled to my home country with an expired greencard, NOA and I551 stamped on my passport. No questions asked when I got back and my immigration process was completed in less than a minute. I would suggest putting the NOA and expired greencard on the passport page that has the I551. Always better to hold on to the expired greencard since it was used as proof in other countries even though it was expired, the best way to get I551 stamped and to keep the greencard is to do the I551 stamping before the greencard expiry date. You can avoid lot of unnecessary questions at airlines counter, immigration at other countries etc if you hold onto your expired greencard.
