Question about keeping both K3 and CR-1 cases open

Hi all,

I would LIKE to keep the immigrant visa application going in tandum with the K3 but I must ask this first...

If I continue with IV and pay the visa fees, does this mean if I THEN decide to go ahead with the K3 visa then I lose all that money for the immigrant visas? If this is so, that would mean taking a gamble with over 800 bucks USD which is just too much for me to deal with.

Yes, if your K3 interview happens before the NVC process completes, the AOS and IV fee will be non refundable.

If your consulate a "friendly" one, you may be able to postpone or delay the K3 interview if the NVC process doesn't complete in time.

What I have done is pursued both paths. K3 and CR1. This will get you a CR1 interview faster. I did everything for the K3 with the embassy. My wife has a interview August 14.

But at the same time, I did everything for the CR1 with the NVC. Just make sure you have everything prepared and do it all through the website. My case was complete for thr CR1 July 16. They just assigned me an interview for the CR1 September 23.

I contacted the Embassy and told them my situation. My file was just sent to the embassy yesterday. The embassy told me they would let me know when they received my paperwork and change my interview on August 14 from a K3 to a CR1 interview. The embassy even contacted the NVC to confirm that my file was mailed, because if it wasn't they were going to get it expidited down there.

But by following both paths, I am getting my CR1 interview about 6 weeks sooner that it would have been.

107 days from mailing paperwork to the CR1 interview.

But remember if there is a hangup at NVC, you might either have to return to the embassy for the interview or wait for the interview.

Thank you both VERY much! You answers have been a great help. Due to our circumstances, the K3 is going to be the way to go. Yup more work, more money, but it's our best option.
