What do we do with the expired I-94?

Mine expired on Dec 20. I have already filed for my AOS etc, so it's just sitting in my passport right now. I am going home on a 2 week trip later this month. Am I supposed to hang onto the I-94 to keep for the AOS interview, or am I supposed to hand it in to the airline (on the back it says surrender this permit when you leave the US).

I went for a trip a couple of months before my AOS appointment, and nobody asked for my original I-94 (plenty of people looked at my passport, and saw it, and said nothing). So it stayed in my passport, along with the newer I-94 until my AOS appointment, when the adjudicating officer took it out of my passport. That's all I can say.

I was under the impression that if an AOS application is deemed abandoned by the Agency when or if the immigrant leaves the states, it is eventually denied.

The AOS would not be deemed abandoned if the OP had Advance Parole. Which, I presume, she has.

LOL! But I have read alot of stories of people getting their biometrics well before the AP, so it was just a bit of a surprise to me that's all. :)

:yes: Strangely I got my AP several weeks in advance of the biometrics letter.

hence, the name Advance Parole ... :lol:
