Hey there, I live in Texas and I want my Canadian girlfriend (because the rings had to be sent back to the store unfortunately) to come here to Texas. We've met in person and all that more than one occassion I've known her on and off for around 9 years. I'm just wondering how I would go about getting her to live here in america. Texas to be exact. I've heard so many different things and I am just so confused. I was told to come here. Thanks in Advanced I'm just so confused right now I have no idea where I should start or what I should do.

If you click on the "guides" button at the top of the page it gives you step by step information. It is a great start because there is so much to know about this process.

K1 is a fiance visa- once granted- she can enter the US, have 90 days to marry and then you can proceed with filing for AOS-Adjustment of status. With AOS comes the Greencard. There are 2 consulates in Canada that handle K visas- Montreal and Vancouver. If she lives closer to Vancouver- it is the norm that her file will go there and she will be interviewed there. The bonus for this is that Vancouver processes much faster than Montreal and can shave several months off your waiting time.

If you get married and then start the process- you would file for a CR1 visa. Montreal is the only consulate that handles CR1/IR1.

I haven't given you a whole lot of information because the guides will explain much of the process.

Just be prepared- immigration is a long and frustrating road. But it is worth it in the end.

We have all been through it and are always willing to help and support each other.

Some people have had no problems traveling back and forth while processing. She will probably be asked to prove ties to Canada- mortgage or rent payments, letter from employer, bank statements, etc.

I wouldn't advise her to pack up and move everything to Texas until she has that Visa, or stay longer than she is legally allowed to on B2 status.

She can't come live here while awaiting a visa. She can come visit, provided she has enough ties to Canada and they let her travel back & forth.

I have traveled to the states several times during our process. I dont think it came up on their computers, I just said I was visiting friends for 3 weeks... (but stayed the 90 days ). Should not be a problem.

Hey there :)

I'm the Canadian and my fiance is the American, and we had the same questions. Read everything you can on here, and I would suggest the K-1 Route. It takes between 6-9 months for everything to get done. Where in Canada is she? Interview times for Montreal are a bit of a wait, but I've heard good things about the Consulate itself.

If she decides to travel, make sure she has proof that she lives in Canada (bills, lease, pay stubs, letter from Emplyer etc). I have talked to a few CDN's who have been denied entry, but I've been lucky so far - 3 trips since filing. And make sure to tell her not to lie to the Customs' people when she does travel. It will be more trouble than good!

6/2/09 - Biometrics at Raleigh field office - they were some of the nicest people :)
6/18/09 - EAD approved and card production ordered
6/20/09- received AP papers in the mail
6/22/09 EAD card arrived in the mail (that was fast eh?)
7/09/09 - received notice of GC appointment date
8/07/09 - Green Card interview at Raleigh Field office at 8:45am - Given RFE for I-693 Vaccination suppliment
9/08/09 - returned RFE to field office. Approved for Green Card
9/09/09 - Received email that Card production had been ordered.
9/17/09 - Green Card in the mail - No more USCIS until June, 2011 :D

The K1 doesn't show but some people have lied about their reasons for visiting the US, been caught out, and had an official note made on the system!

I agree, do not lie! K1's do not automatically show up in the system unless you tell them but if you say you're staying 3 weeks but 'next time' the departure record (which they will see ;) ) will show you were not truthful. It would certainly add extra scrutiny next time. There is no reason you can't stay for as long as the visa is valid. Your only concern should be in proving you are not intending to immigrate by showing ties to your own Country. It's a ####### shoot really.

You don't need to offer anything if you're not asked. If you're asked who you are going to stay with... 'a friend'. If they delve deeper... tell them the truth...always. ;)

You mean you're visiting your fiance. If you're going to be down there for the 180 days you're allowed to within a one year period, then make sure you bring plenty of ties to Canada. ie. Paid rent receipts, letter from employer, utility bills, mortage or deeds, car payment details...anything that will prove to them you still have ties to Canada.

You mention you're "moving", hope you're not doing that figureatively! If they see you're moving any "stuff" over with you, you can be you won't be getting across the border.

Any or all of you Canadians should visit the Canadian forum here on VJ for lots of specific Canada/US issues.
