Hello guys and gals.

I've got a interestings question. I just got a new job, well acually I am going to be a independent contractor. I will be starting on monday. I'll give some background of my situation. I was off work about 6 months last year due to a injury and worked for 4 months. I finally had surgery January of this year and I am unable to return to my line of work.

My question is with my new job I will be earning between $150 to $200 a day. Lets just say a average of $45,000 a year or $175 a day. I am wondering if I will still need a co-sponsor due to the fact that my last year earnings was around 9,000 for the 4 months or if they will take into account the new job and what I will be earning per year. Based on time lines I should (I hope) be approved and off to the NVC in a month so. Will this be a issue and still need a cosponsor?. If the NVC approves what are the chances of the Embassy rejecting due to not being on the job long enough. I hope this all makes sense as I am giddy with excitment!

From the I864p I need to make around 31,000 or is it 35,000 a year due to my family size.

You don't need co-sponsor. But include a letter explaining your situation, just in case, to avoid RFE.

Could I include a copy of my last year bank records? I had almost $40,000 in deposits from workers comp, unemployment and work? Would that also help? What all should I include in a letter? This job I am starting is contract labor. I contract from another company to install satellite systems that they sell. So I dont really work for them other then they make the sell and I get paid to install the system. I am responsable for all my own expenses. I am kind of at a loss as what to say in the letter.

Hi RMMCM,

I'm in your same boat... I posted nearly your same question about a week ago, and noone responded. I'm unsure if I should have my cosponsor "just in case" the consulate decides to be suspect about it. (was a grad student, travelled last year and got married, just started a job last week making $35,000/yr...). I'm not sure if there is some sort of needed timeframe for earning enough money. What are you going to do??

I think if you just have a letter from your employer stating how much you make and that it is a permant full time position they will understand the situation. They just want to make sure that you can support your spouse and yourself the first year.....at least and they do not become a strain on the state.

Thanks for answering both our questions but mine is still just a little unanswered, I will be the boss, I will just get contracts to install system from another company. It will be the other company that pays me though so would I just get a letter from them?

yes... whomever signs your check you will need that letter from...

By definition, self employed people cannot provide "employer letters".

Facts are cheap...knowing how to use them is precious...

Yes, you should write a letter with brief and to the point explanation of what you just wrote here.

You will not be able to get an "employment letter" with your new job, but you should get a letter from them confirming you contractor status and if possbile, stating anticipated income.

Also, you should include assets. It is explained well on the 864 instructions how to do it if you do not have enough proven income. Home equity, savings, etc.
