K-3 and CR-1 for the most part are taking about the same time.

How about researching this using VJ timelines? Just select Advanced view, filter for Canada, sort by interview date and look at the tome from filing to interview column.

Do you want to be able to work shortly after arriving in the USA, if so then consider the CR1 visa, it is work auth, K-3 is NOT.

Keep in mind, getting green-card may be quicker from doing the CR-1/IR-1 process through NVC verses adjusting from K-3, it is also less expensive over all.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

NOTE: K-3 cannot, take a job, apply for SSN, or apply for a driver's license until they have EAD, or green-card, EAD can take 90 days or more to get. CR-1 gets green-card upon entry to the USA.

Compare timelines: K-3 was originally developed at a time when the Immigrant CR-1/IR-1 was taking a very long time, this is just not the case any more, NVC has streamlined many processes.

got cért and geting licence soon im in us for a visit didnt tell custom we r maried leaving 4 cånada soon what shoud we do? Apply 4 k3 and how long bfore i get approved?thx

K3's are taking about 8 to 10 months to be approved.

Everything you need to know is in the Guides. You are already married, so yes, a spousal visa would be your best option.

You came to the States to get married or were you already married prior to entry?

Streamlined is a relative word when you look at the CR-1's coming out of Jamaica.

Lucky for him it's Canada, I suppose.

We gnt married in canada and then i came to us for a few weekr

if i were in your shoes I wouldn't bother with the K3.. and go with the CR1.. it might take a little longer but then you don't have to go through AOS and all that...

I agree with Marilyn...at this point you're best off going with a CR1. It's less expensive and includes the green card and work permit as soon as the Canadian citizen crosses the border.
