My Fiancee from Mexico came to the US with me on May 21st of this year ! We were married on the 24th Now my Wife :dance: . Our K1 visa is good until till August 14th. I know that we have to file the I485 to adjust our status. But what happens if you can not file before that date ? What should we do. Thanks Chuck and Teresa

to my understanding there is no timelimite to when you have to file AOS , some people even waite for a year before filling AOS , the 90 day timelimite was to get married after arrival in the US ,

( wich is what you guys did ) so no worries you got your marriage cert that shows the date you got married as prove that your ceremony was within 90 days ,

the only thing you have to remember your spouse wont be able to work or travel outside the US untill you guys file for AOS and resieve the proper documents for it ( EAD and AP or GC ) good luck

better to file sooner than later....although the most important thing is that you both got married to one another within the 90 days of the K1 expiring...

Keeping in mind the sooner you file for AOS the sooner you get the Green Card and then the sooner you can life conditions! =)

Just for the record and future readers, the K1 visa itself is dead on arrival. The visa expiration date is of no consequence whatsoever, once US entry has occured. The I-94 expired in 90 days but because the entry status was K1, there's no consequence for filing the AOS late provided it does get both filed and approved.

Facts are cheap...knowing how to use them is precious...

as a point, technically the K1 is not dead on entry. It is fulfilled upon the marriage. The difference is that in rare cases you can apply for and reuse the K1 if an extenuating circumstance causes a delay in the marriage. I have never heard of it ever happening but I have read about it.

as a point, technically the K1 is not dead on entry. It is fulfilled upon the marriage. The difference is that in rare cases you can apply for and reuse the K1 if an extenuating circumstance causes a delay in the marriage. I have never heard of it ever happening but I have read about it.

Actually, the K-1 at the discretion of the consulate, can be approved for a second entry, however, the 90 day clock from the original entry remains intact and marriage must occur before that time.
