I think I've posted about this before but I'm not sure. I was just wondering if border troubles cause significant delay in gettting a visa or what? I was turned back twice, the second time with a 12 month border block put on me. I guess I was visiting too often and with not enough proof to come back or whatever. I feel so bad about it but I really didn't know what I was getting into and it was a mistake and now I think I'm paying for it with this 4 month and counting wait. Sigh. I don't have a criminal record and never been in trouble with the law so I can't see why this would end up in a refusal of the visa. I'm just nervous because it's taking so long and I have no idea whats going on. I guess I could look at it this way......at least they are doing a thorough review and hopefully by spending a little extra time to figure out that I"M NOT a criminal right? If they do it now then it should be all cleared up for when it comes time to AOS. Positive thinking much? :yes: I'm trying to be more positive because being negative isn't making things go faster.

Whether there are problems or not depends on the reason one was denied entry...

Why was there a ban placed on you... Did you make a material misrepresentation?... Did they give you anything when they give you the ban...

If so, then you may have to file a waiver to get a visa...

Maybe they are looking into WHY you had a border block put on you? I can't imagine why visiting once a month would have been a problem - unless the border agent was feeling particularly snitty! I've been visiting regularly for almost 4 years. I just can't see why two or three visits in a row by you would pose such a problem.

Well they just told me cuz I didn't work that there was no proof I was coming back to Canada. I know the one time I didn't have a return ticket so I can see why that would be a red flag and it makes sense. But I was let across a week after that with no problem. Was there for 2 weeks (California) then came back and tried to go for the holidays 2 weeks later. I had my return ticket and everything but that wasn't enough I guess. I was grilled really bad and it was just a harrowing experience I wouldn't wish on anyone. I still have nightmares about it happening again. I think I was descriminated against because I wasn't working and I was 24 and still living at home. At least that's what the agent said "you need to get independant and move out of daddys place" is what i think he said. not fair from what i see it because they shouldn't be able to tell you that you HAVE to work or what to do to live your life. oh well. its over now and im just thinking maybe that's why its been 4 months and i haven't had my noa2. Nope nothing was given to me when they gave me the ban, he just made me tell the airline not to allow me on their list for 12 months and entered me in the computer with fingerpints and all. dude was hella rude too.

It was a lot easier for me to travel to the U.S. from Canada to visit my fiance when I had a job. After I quite working, they wondered if I would come back to Canada after my visits too.

I took my lease papers and my most current utility bills with me and I was always let in, but I was told that they don't have to let me in every time because there was some doubt as to whether I would return. They were suspicious about how I was able to support myself without a job. I had quit my job after I met my fiance, and used savings to pay my rent in Canada and my fiance helped me out too.

I drove across the border, though, I did not fly into the U.S.

I am so sorry this happened to you, I am feeling way blue myself today after a crappy interview yesterday.

My husband , then fiance in Jan 05 was denied entry into the US from Alberta. They also said, he did not have enough proof to show he was going back to Canada as he is a self-employeed business owner as well as he was visiting too much. He didn't get banned, but they told him if he tried to cross elsewhere or even within a few months of the denial he would be arrested and then banned from the US. So he stayed home, he tried to get a B Visitor's Visa at the embassy in Calgary but was denied as well. We did get his K-1 last July so him abiding by the laws did help I guess, or is it all a scare tactic?

This is the crappy thing that yesterday in the interview the INS lady was trying to manipulate him into making a mistake with his dates of crossings to try to get him to look as if he had crossed illegally once or overstayed his I-95's. She had all the dates of his crossings in his AOS file ,except the one that was hand written by a POE officer in his passport when he had tried to cross in 05. She kept grilling him on the dates to the point he got frustrated and started messing up the dates. I had to defend him and tell her he gets frustrated with remembering dates ,when she commented he was awfully nervous.

I wish you good luck with your K-1.

I was denied entry to the US in Dec, 2004...... they told me that if I ever enter the US I will be arrested immediately....... I didn't go through the border since, I have a feeling that was because they didn't find "enough evidence" of me coming back to Canada.......... Even though I had a job, and had my recent paystubs from work(in my purse)...... They kept me at the border for 4 hours!!!! That was ridiculous, because, I was treated like a criminal and I didn't do anything wrong........ That time I was travelling by car (my fiance's car - he was with me), other times(before) I always took a plane with return tickets..... It was a horrible experience, they didn't believe that I'm just going on vacation..... in my case I wasn't living with my parents for a long time, so the guy asked me how come I don't live with them? wouldn't it be easier(financially I gather)....

now on June 5th I have an interview, and I'm sorta scared because of this denied entry.... mainly because, I don't even know WHY I wasn't let across the border...

You mean I'm not the only one? Man......when that happens to ya it sure does scare ya and make u extra nervous the next time around. I mean those border guys are doing their job and I realize this but some of them are way more intimidating and rude than they have to be. Next time I go to cross my fiance will be with me and I will have the k-1 in hand. I'm not chancing another run in even though my border block is lifted. I don't need anything else hindering this process more than it has been already.

My fiance was denied entry into the country in May. We were driving down and he was planning on staying for an extended time (4 weeks). He had left his seasonal job and since he lived with his parents, he had no lease. The border patrol were pretty nice about it, they explained it all to us and told us to contact them if we had any questions or wanted to attempt again. He wasn't fingerprinted or photographed and there was no border block put on him, but he was told to "re-establish ties to Canada for a few months."

We are planning on sending in all of our K1 stuff in September, we are hoping that he can come down and spend a week with me before we send it off. He hasn't even met my parents yet. :( So we are hoping that if he is traveling alone, by air (has a return ticket) and also has a letter from his employer, he'll be fine.

My fiance and I wer travelling back and forth before the engagement weekly untill he moved further away, since the engagement it's been monthly and I've had no problems and I've been truthful about everything....I always show my return ticket and have a letter from my employer just in case. Good luck, I always fly out of Buffalo N.Y., via the Peace Bridge.
