Hello all,

I am a newbie here and need some help. My fiance' and I plan to get married, however his visa expired years ago. We both currently live in the States. Does anyone know what steps we need to take for him to become "legal"?

Also is it harder to get approved once someone has overstayed a visa?

Yes you can do it. He will have to adjust status filing I-130 and I-485 with all other documents and forms requested, plus I-485A and pay a fine of 1.000 dollars on top of all the fees.

18 July 2008 - AOS package sent to Chicago

21 July 2008 - Delivered at 8.38am, signed by R. Mercedo

24 July 2008 - Checks cashed, NOA sent for I-485, I-130, I-765 and I-131

28 July 2008 - NOA received in mail, applied for State ID

29 July 2008 - Case viewable online

04 Aug 2008 - NOA for Biometrics (sent July 30)

20 Aug 2008 - Biometrics done

23 Aug 2008 - Received State ID card, valid for 4 years

05 Sep 2008 - Received new corrected State ID

24 Sep 2008 - AP and EAD approved

04 Oct 2008 - EAD in the mail

05 Oct 2008 - AP in the mail, applied for SSN

07 Oct 2008 - Job interview

10 Oct 2008 - First day at work

20 Oct 2008 - Social Security card in the mail, got my first paycheck

11 Dec 2008 - Passed driver's knowledge test

24 Dec 2008 - Notice for interview

19 Feb 2009 - Interview

27 Feb 2009 - Welcome letter - APPROVED

06 Mar 2009 - GREEN CARD ARRIVED

Removing of Conditions

03 Dec 2010 - I-751 sent to California

06 Dec 2010 - Package received

You do not need to file the form I-485A if they entered the US legally. (which if they have a visa they did.) Overstays are forgiven as long as you have not left the country since you became an "overstay".

only I-130 and I-485. you don`t need I-485A because you are USC, right???

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

Sorry, wasn't reading carefuly. They are right, if you enter legally , overstay and marry USC you do not need supplement. You should be forgiven.
