May be the OP can marry the mother of his child. Still long waits with waivers etc.

Other than that no other way to file a petition. Waiting 20 yrs for child and then file seems like an unsually long time to live in the shadows. There are still some western countries with less strict immigration policies.

Did hear on the news this morning, due to the state crackdowns, an estimated 1.3 million illegal Mexicans returned to their homeland. I would think the Mexicans would prefer to stay in their home country, but need better opportunities to survive and it appears that their corrupt government is one of the key problems.

Amazing how a country like Japan with practically zero natural resources can do so well. Maybe those returning Mexicans will do something with their government.

Both dealing with illegal aliens with American born children, what they are doing is deporting the father, leaving the mother with no means of support because of her American born children, so she has no choice but to go back as well. I suppose the kids can come back when they are old enough and can do so legally.

Besides the Nigerian OP is just asking for advice for a friend, and exactly what is the origin of his friend? Another Nigerian? Or a Mexican? What difference does that make anyway, Dude! They are both her illegally, and that is the only factor that makes a difference.

According to our US Constitution, we are suppose to have a government for the people, run by the people. We are the people here, did anybody ask you about our immigration laws and what they should be? They sure didn't ask me, was just told what I can and cannot do and how much to pay.

The difference is your assumption with no evidence. That is the difference.

To the OP, consult an experienced immigration attorney who specialises in overstays. The best advice you can get..

Never heard of an Immigration Lawyer that specialises in overstays.

2 options:

Assylum

Marriage to a USC assuming the person entered illegally.

As has been said the child could sponsor, once 21 and once the parent has served the ban.

OK, I'll play: Why did he not return to his native country with his family before his tourist visa expired? If he entered with his family on a tourist visa and now wants to stay with his "family", are we talking about the family he entered with or are we now talking about his new family (girlfriend & child)? It is unclear if the entire family overstayed their tourist visa's or if you are speaking of his new family. Either way there does not seem to be much hope of legally staying. But it may depend on your answers to these questions.

p.s. Lou Dobbs sucks!!!

A Senator could sponsor a bill purely for them.

A USC child can sponsor when they get to 21, but they have a 10 year ban to serve outside the US first.

I haven't either lol.. I meant I know a lawyer who extensively deals with overstays in his career.
