Hello everybody,

I'm trying to remove condition of my green card by myself now that after I'm divorced but I have a BIG doubt. Is it true that if I tell Immigration Services that I had a Catholic Ceremony in Mexico before we got here and then one month latter we had a religious and legal ceremony by his father, will they take it as Marriage Fraud??

We got a K-1 visa and made plans to get married in USA, but then we also wanted to have a ceremony in Mexico and a party with friends and family that was not going to be able to come to USA (including my parents) for visa reasons...

Religious weddings in Mexico have not legal power in Mexico... I don't think they could have it here... Could somebody help me? I'm very confused :)

If the wedding in Mexico was not registered with the government, then it was not a lawful one.....

You left out one important aspect about your marriage, the license!

Is required in Mexico:

http://marriage.about.com/od/international/p/mexico.htm

And in every state in the USA, but you have to have that license first. How you can get married varies widely, in my state, you can do it yourself, but have to register it before it's legal or you can spend a million bucks for a big church wedding or even get hitched by an approved attorney, but that is expensive as they charge over 300 bucks an hour that adds up when he drives over to register it.

It's that license that does all the checking, are you of legal age, are you free to marry, how many marriages did you have in the past, are you paying child support, etc., with a whole bunch of other questions. And you said you had a ceremony here by his father? Did you get a state license for that marriage?

Other state have common law marriages, simply living together for a period of time, the state considers that a marriage, and to break that up, have to go to a divorce court.

So are you even married?

Whoever told you this was not thinking straight and gave you the wrong info. You should be fine and your legal marriage is the one you had here in the States. Many people get married in a religious ceremony in Mexico fully aware that it is not a legal one.

You should be fine.
