Hi Guys,

i will be going for my interview on the 11-08-08 and my medical on the 12-08-08 which means as my wedding date was 18-08-06 i will be issued CR-1 but from what i can gather when i enter the IO should give me IR-1 does anyone know if this is true or if there are some pages i can print to back this up?

from what i know, if your POE is after your 2nd marriage anniversary, you get a IR-1 regardless of when you get your visa from the embassy. You may want to confirm that with someone at USCIS or the consulate where you appear for the interview coz if you can wait a few days to enter, you will save the time, hassle and the money after two years to adjust your status. It sounds you will get IR-1 if you enter the US on your immigrant visa after 19-08-08.

Medical should be before the Interview but it doesnt have to be. Mine was originally booked for the end of August. They just wont issue the visa until the results of the medical come through.

Throwing this one open i know it says in the Letter that interview dates cannot be changed unless for a very good reason is it worth Changing the Interview date until after the 18th just so its on the IR-1 side instead of CR-1 and thereby save myself alot of hassle? or will they just schedule one for next week instead?

I made sure that NVC changed my status from CR-1 to IR-1 before it left for the Embassy because there could always be mix-ups. You can try to email the Embassy and ask them.

tried but they deleted it don thave the code or the money for the extortion line i think ill send a special delivery letter

It is not necessary to change your interview date. You will be issued a CR-1 because at the time of interview, you have been married less than 2 years. As long as you don't activate the visa until AFTER your second anniversary, they should code you as an IR-1 at the POE. (I have had this clarified more than once to make sure.)

You really need to point out the dates on your marriage licence at the POE to make sure they know 2 years has passed. If they don't do it, you can make an infopass appointment and have it corrected.

In this thread, the terms CR1 and IR1 have been used to indicate both visa category and immigrant status category, which are not the same thing. CR! and IR1 are both visas and status. In this case the CR1 visa holder will be entitled to IR1 immigrant status if the US entry is after August 18. (the two year anniversary of their marriage). Their visa will still be a CR1 visa but their upgraded status will result in a 10 year green card.

Often CBP officers miss this, so it's wise to carry your marriage certificate and specifically point it out. If that doesn't work, you can correct it later with and "infopass appointment". People who can find this site can probably find it's "Immigration Dictionary" or simply google "infopass appointment" to take it from there.

Yes, you should be issued an IR1 visa because the visa will be issued after your interview, after the medical, and after your two-year anniversary.
