I entered here at the US with my k3 visa on june 25, 2008 and will expired on june 25,2010 . i'm planning to get EAD first by september and file the AOS by december or before the 2 years anniversary on march 2009.

my I-130 got approved last march 2008 and before i got the visa for k3, i responded the letter for choice of agent address that was sent to me for I-130. after that we just pursued the K3 visa. my question is, is the I-130 have an expiration? if we filed for AOS, we will need the case number for I-130?

do i need to call or contact uscis that im here as a k3 visa holder?

For this purpose, no it does not. We went one step further and paid the $70 fee after choice of agent before I stopped responding to NVC. My wife and daughter's I-130s were approved 15 months before filing AOS (during the 2007 Summer rush) and 22 months before AOS was approved. We also applied early for EAD but that was under the old fee structure. Now, if you file ahead of time you pay the (is it $340?) but filing together requires no fee.

Facts are cheap...knowing how to use them is precious...

If you file AOS right away there's no need to pay the $340. If you file for EAD first, you pay the $340. Sounds like you want EAD first and then the green card after the two-year anniversary so it will be for 10 years.

Or are you talking about the removal of conditions shortly before the two year expiration of a conditional green card.

Not bad at all. It will just cost your an extra $340. Unless you need it early, no need to file separately.
