My wife's children went for their "interview" today. How you can interview a 3 and 4 year old I don't know.

Their visa was denied because the interviewer said she doesn't believe they are my wife's children! What the hell kind of nonsense is that?! They have the NSO birth certificates which they said wasn't enough "proof of relationship". Do they think we just grabbed two kids off the street? What is wrong with these people?!

Now they want us to do this DNA test which I'm sure is going to be ridiculously expensive and will take long enough to ensure that they will no longer qualify for the K2 visa forcing us to start all over again and pay all the fees again.

I'm unable to find any specifics on the cost or time involved with this ludicrous DNA test requirement but I'm sure it will not happen by Nov 13 which means the children will no longer be eligible for their K2 anyway.

I'm really hating these Manila interviewers at the moment. Not her kids! What is wrong with these people?

I'm so sorry to hear that... That's terrible. I don't understand why if she had their Birth Certz that she wouldn't believe it.... OY! :bonk: DOes she have some way of getting hospital records? Maybe that will be the key. The DNA test is a go for sure. If they don't beleive ya, proof them wrong! :bonk:

I am very sorry you have to go through this. Unfortunately, I am not help. I do hope you get this figured out, and be sure to let us know what ends up happening. Do you know how long it takes to get the DNA tests?

9/07/2008 Jorge flies to Juarez for Med and Interview

9/08/2008 Medical Date- went well :) He stood in line since 5:30 Am. He finished at 11:15 AM - ish

9/09/2008 Interview- SUCCESS!

Did your wife attend the interview with her kids?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

My wife is here with me in Florida. Her mother and sister took the kids to the interview.

They said they didn't believe the birth certificate apparently because they were "late registration" whatever that means.

Anyway, I called the embassy last night totally livid and yelled at a bunch of people there. Demanded to talk to someone with some authority, etc. Made me feel a lot better and the last guy I talked to was the head of the immigrant visa department. He said if we can send them pictures of my wife with the kids from the time they were babies till the time she came here with me that he will approve he visas and we won't have to start over or even bring the kids back to Manila again.

Pictures we have LOTS of so this should resolve the issue.

But I did learn that you can call and talk to the actual people involved at the Embassy. If you are a US citizen, call US citizen services and demand to talk to someone with authority in the immigrant visa section. Tell them you're calling your congressman and senator and you want to know who to report as the individual who is arbitrarily and capriciously keeping your family separated.

Yes, in Manila you can do this but in many/some countries you cannot.

It's great that you found a solution. It sounds like the combination of late registration and the mother not being present is what triggered the initial outcome. We can learn something from that as well.

Facts are cheap...knowing how to use them is precious...
