This gent's shot at success is about 2%. Just telling the truth. You are in deep here. HCMC is the most brutal of all consulates. They deny for any reason and frequently for no reason.

Get yourself ready for the worst case scenario. And get your lady love ready too.

If he wants to apply for his petition soon, then I would agree that it would most likely raise questions somewhere in the process. HCMC is very particular with their cases. I think it's a bit unfair to say they deny for "no reason". I understand that for many people here, HCMC is denying visas incorrectly, but it's more accurate to say that HCMC is denying visas because they are ultra-suspicious on every case.

seler, the fact that you had to put the disclaimer, "Please dont criticize my poor judgement in cancelling an application and then turning right around starting a new relationship" signifies that you are well-aware that this is untypical or special circumstances. I have no reason to think you're lying or that your feelings for Phuong aren't true, but it's only because it's not my job to scrutinize your relationship. You should be less afraid of our criticism and more concerned of what USCIS or the consulate in HCMC will think.

I would recommend consulting with Mark Ellis first. Mark Ellis is a well-respected attorney who has helped many people on here. He would have a much better feel for the correct path for you. I would wager, tho I'm not 100% sure, that everyone who has responded to this thread has not experienced exactly what you've gone through. All of our advice stems from our experience of having a "normal" petition and from those who have experienced pain and seemingly-random suffering from the consulate in HCMC. Mark Ellis would draw on a much wider-base of knowledge.

I appreciate everyones responses to my dilema.

At this time I am planning to visit my Fiance for 10 days in early Sept. I will of course keep all my travel documents and we will simply enjoy our time together and Im not going to get too concerned about how difficult the process will be getting her K1 visa approved.

I have written a formal letter of cancellation for the relationship I spoke of in my first post and I imagine it will take weeks for that cancellation to process. In the meantime I will just enjoy the new relationship I have begun.

If we are meant to be together as I feel we are then I will just be patient and follow the laws as necessaary. I will submit for the waiver and explain exactly what happened with the resolution of the first relationship.

What is the worst case scenario for me?

That I have to wait 2 years and before applying again?

I will reach out to Mark Ellis and see what he thinks, thank you for mentioning his background to me Lucky D.

Finally, I know I screwed up starting an app and having to cancel, I had no idea how heavily scrutinized subsequent relationships would be. So for now I will just wait a few months and let Phuong and my relationship grow and hopefully next year begin the process anew.

Being there for only 10 days would probably be a problem as well. If it were the Philippines it would probably be O.K.. Evidently fraud doesn't exist there.

I would also recommend contacting USCIS immediately to cancel the initial I-129F.

If your fiancee's interview will occur at Ho Chi Minh City, then be prepared for an uphill fight. The US Consulate at HCM has a high number of scam engagements/marriages that they have to filter out. They scrutinize everything very carefully. There have been a number of folks on here who have had their case initially denied outright because a question asked at the interview conflicted with information written down. In one case, it was something along the lines of "second cousin" versus "uncle". One was being more exact describing the familiar relationship and the other was just using their everyday language. (Like, for me, when I was growing up, I always called my neighbors "uncle" and "auntie", even though they had no relation to me.)

Be prepared that you and/or your fiancee may be asked a lot of questions about this at the interview.

It's also very common for the consulate in HCM to issue a blue or green slip at the first interview asking for more information.

I don't know anything about the process at the US Embassy in Hanoi. (Or even if they process K-1/K-3 visas there. Ever Vietnamese story I've read on here has gone thru HCMC.)

Mark Ellis probably can answer these questions a little more. I've never used him, but lots of folks going thru Vietnam have and have said really positive things.

You didn't screw up. When the heart is involved, sometimes we do things we normally wouldn't do. Heck, even now when my wife bats her eyes at me in the mall, I still reach for my wallet. hehe.

I may have come off as a little harsh, and that wasn't my intent. I think it's safe to say that all of us on here want you to have success in getting your fiancee here. It's just that the consulate has very little incentive to allow her to come and a lot of incentive to sniff out something they consider "suspicious". Matt Stevens has the gist of it that they sometimes see smoke and automatically assume there's a fire. So we want to make sure you don't give them any excuse to reject your petition.

Greetings everyone,

I thought I would keep this thread alive and give a quick update on my situation.

I am leaving Sept 4th for 2 weeks to meet my sweetie and establish/document our relationship. This is a dream come true for me and we are both so excited to meet each other. My partner is fully aware of my recent relationship that ended and we are both moving on with our lives together just as anyone else would.

I submitted my letter of cancellation for the I-129f to the woman from China 2 weeks ago and of course have not heard from USCIS as yet that they have received it or any action taken.

My question is this:

Would the VN consulate be more forgiving and tolerable of my fiance application after I have visited VN 1 more time later this next spring? I realize I would be crazy to submit another application right now so soon after the resolution of my first but what if I reapply next spring?

Any opinions or related experiences would be appreciated.

I think you may want to look elsewhere for your sweetie. Vietnam is so hard to deal with when it comes to this process. I have not completed it yet but I have seen the struggles others have gone through. I am hoping my path will be less bumpy but you never know. I fear you are setting yourself and the woman you are going to see for some big time heart ache. You may want to take a good long look at what others have said so far and ask yourself if this is how you want to spend your last petition chance. I understand that you my only file 2 petitions within 2 years befroe it becomes almost impossiable to file another. My advice would be if you are intent on bringing a woman to America from another country I would try a country where it is much easier to complete this process.

I thought I would keep this thread alive and give a quick update on my situation.

The number of trips is only part of the equation. I made three trips to VN before Tuyen's interview and our case was sent back to the CSC. Will it help your case, yes. Will it be the difference between a visa and a delay/denial, no.

Greetings all,

Im a new member and have a question about overlapping applications.

I submitted an I 129f application a month ago to the cal USCIS office but I realized I was making a mistake marrying the chinese woman due to a number of circumstances and I have terminated the relationship. When the USCIS contacts me regarding the application I will cancel it.

I have since met a vietnamese woman I am deeply in love with now and I am ready to start the application process all over.

I apologize but I am just dying to know something here. Maybe I am reading this wrong.

You submitted a 129f, realized you were making a huge mistake and terminated the relationship and since that time you found a awesome lady and are deeply in love.

You went through all this in 1 months time?

Listen guys, Im feeling pretty frustrated with all the negative comments around my situation.

Yes it is true I made a mistake with a woman from China who was not honest with me and deceived me. I cancelled the relationship after I found out I could not trust her. 2 days after I ended the relationship I signed onto another dating site looking for a woman from Vietnam as I have always been fascinated with the Vietnamese culture and when I was younger I dated a woman from Vietnam for several years but when we decided to get serious her parents would not accept her marrying an American and we eventually broke up.

As the things go I was contacted by several women on the www.vietnamcupid.com website, but 1 in particular I found very interesting and of course attractive. Phuong reached out to me and we have been communicating everyday for several hours. I am very happy in my new relationship and yes I do feel genuine love for her and we cant wait to meet in 10 days for the first time.

We are going to take this slow and I am prepared to wait 2 years if I have to for reapplying without a waiver. I am more informed now and I understand the VN consulate will scrutinize our application but I am confident we will find a way to be together eventually. Phuong speaks and writes english very well and has an english degree from the university in Nha Thrang, we both have friends who have gone through the process and we will leverage all the support we can to carefully navigate the process.

I hope this helps people understand our situation and I look forward to sharing our story with everyone as we go through this process. I will post pictures when I return from my trip so everyone can meet us :)

I believe you can be sucessful with Phoung because you understand more about what you're getting yourself into in applying for a K1 visa from Vietnam and having cancelled the other I-129f.

The fact that Phoung speaks English well is a big plus.

If the two of you are willing to wait 2 years before applying that is also a plus, however, the main concern is to properly prepare your I-129f to explain the cancelled I-129f. Any and all evidence of the Chinese woman's decieption as well as how you found out about it plus explaining why you decided to apply for the I129f so quickly needs to be convincing to the USCIS and HCMC Consulate.

The cancelled I-129f will make USCIS and HCMC Consulate more closely exam your new I-129f so you need to make sure you build a 150% stronger case for it. Everything possible to show how you and Phoung have a real relationship that includes your family and friends, her family and friends, etc needs to be filed in your I-129f. By making your I-129f answer every possible red flag, you should find her interview will go smoothly. If not then you'll find a bumpy road, but if the two of you love each other, remember, you will be together in the end no matter how long it takes. The Consulate wants to stop immigration fraud, not keep people who are in love apart.

Well I guess I did read it right. You feel frustrated? What about all of us that are going through this embassy that are and have been scrutinized heavily and getting creamed because of all the fraud through VN. Excuse us for not jumping for joy for yoyu after reading something that smells fishy. It is this type of stuff that makes it hard on the others. Keep reading here and you will see real frustration.

I am new to this forum and the whole USCIS process, I do see many others who have had unbelievable experiences for many reasons. Each one of our cases are different and who knows what will happen with each application.

Why you feel the need to vent against my post I dont understand, I am not a serial applicant Im just naive and uneducated about ####### I got myself into.

You seem to think I am some sort of marraige broker or something and calling me out without knowing the full details about me or my story is in my opinion inappropriate and immature. I dont appreciate this comment in particular:

Who the hell are you to insinuate that I am some fraud dealer of some sort? I hope you will reply and explain exactly how what I have done by cancelling an application just as millions of others have done is contributing to making the process harder for everyone else? Actually its not necessary to reply back whats happened is over and I am moving on.

Phuong and I know exactly what we need to do and we both have immigration lawyers available who will help us as we decide what our next steps will be.
