Which visa is right?

Timeline

Hello Everybody,

I have been going through the visa process for quite a while now and am awaiting approval on my wife's I-751, but do not know how to advise a friend of mine. His situation is this. He is an American citizen. His girlfrend is 3 months pregnant with there child and living in her home country of the Philippines. He is here, but will be going back to the Philippines in October indefinately. Should they apply for K-1? K-3? CR-1? I am assuming that the baby will be a U.S. citizen at birth. Should they wait for the birth of their child before doing anything? Sorry about the many questions. Thanks in advance for any and all input.

3/30/2006 Apply for SSN (Meaw's maiden name)

3/31/2006 Married! San Francisco City Hall

4/07/2006 Received SS card

4/14/2006 Apply for SSN (married name)

4/22/2006 Receive new SS card

5/17/2006 Mail I-485 and I-765

5/19/2006 Package received at Chicago lockbox

5/28/2006 Received NOA 1 for I-485

6/06/2006 Received NOA 1 for I-765

7/01/2006 Received RFE (Birth Cert. and I-94 copy, had already mailed it to them, whatever)

7/24/2006 Letter from USCIS, Interview date!! (September 6, 2006)

9/06/2006 AOS Interview, Success!!

9/11/2006 Letter from USCIS "Welcome to America"

9/13/2006 E-mail from USCIS "We have ordered you a new Green Card"

9/19/2006 Greencard arrived today!!

6/24/2008 Mailed I-751 to CSC

6/27/2008 NOA notice date

7/03/2008 Received NOA in mail

7/07/2008 Biometrics notice date

7/11/2008 Received biometrics appt. notice

7/23/2008 Biometrics taken

10/24/2008 Approved, Card Production Ordered!

10/31/2008 Received 10yr green card in mail!

N-400 Journey

9/17/2009 Mailed N-400 to Phoenix Lockbox

They should wait until they have a plan to return to the US before they do anything except document the child as the child of a US Citizen.

If he stays more than 6 months he can marry her there and do a DCF [i-130] CR-1. DCF is much faster.

He will have to do CRBA at USEM to get the childs US Citizenship.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Consular Report of Birth Abroad. In the PI, they may require a DNA test because the parents aren't married.

Consular Report of Birth Abroad. In the PI, they may require a DNA test because the parents aren't married.

Having to have a DNA test is up to the CO. K1 friend of mine recently went thru the CRBA process at USEM and the DNA test wasn't required. His wifes skin is beautiful brown and he is white. Baby popped out white!!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
