Timeline

Finally after the journey I'm in USA with my Fiancee :D

I'm a K-1 Visa Holder preparing to apply for a Social Security Number and a I don't know what answer to check in the item number 3:

"Legal Alien Allowed To Work" or "Legal Alien Not Allowed To Work" considering the POMS Section RM 00203.500.

Legal Alien Not Allowed To Work

Then you can update your SS card after you received your GC, by then they will issue a new SS card without restriction.

I didn't have to fill in the form myself - I went down to the SSA two weeks after POE and they did it all for me, then I got my card a week later :)

Correct me if I'm wrong but I thought K1's where "Legal Alien Allowed To Work"? Upon entry they are eligible for a 90 EAD even though most don't get it or use it they are still eligible therefore eligible with it to work?

When we did my first SSN application we selected legal alien allowed to work as the K1 is employment authorized. I mean they still stuck the "Not Valid For Employment Without DHS Authorization" on it anyway as I'd have to show documentation that I was allowed to work e.g. EAD or Temp EAD but the SSN could be used to work with the additional documentation. Selecting "Legal Alien Not Allowed To Work" might cause problems would it not if later used with an EAD or GC? I mean I could be wrong I don't know how the SSA works nor do I really want to, I'm just thinking the what if's here.. no need for extra hassle down the road.

I do know from our experience you can have the "Not Valid For Employment Without.." restriction removed once you have your GC but you have to apply for it, submit an application for a replacement SS Card. Don't count on them issuing a new SS Card without applying for it or without the restriction. We printed the FAM notes from the SSN website took them with us after I got my GC and had to argue our case with an arrogant SSA employee who thought my SS card was fine as it was. Be prepared, bring a copy of their rules and be ready to backup what you ask for as they can be wrong and without proof they'll not back down. Although if your in an area that has lots of immigrants anyway you could be fine.

If you are applying based on your K-1 status with an unexpired I-94 as proof, then it's "Legal Alien Allowed To Work." Keep in mind this is ONLY SSA policy/procedure for assigning an SSN.

Yes, as far as i know,

if you have the Work Authorization Stamp from JFK or your POE, then you are "LEGAL ALIEN ALLOWED TO WORK".

Since this is not a regional forum why are people posting in Spanish? If everyone starts posting in whatever language they feel like that is gong to be a Tower of Babel and not do any one any good. If your English isn't that sharp, I assume your spouse is a U.S. citizen and speaks English and let them write your question.

When I applied for my SS card (K-1 holder) I put Alien Allowed to Work. There is a link on this forum somewhere to an instruction for SS officers saying that K-1 holders with unexpired I-94 are allowed to work....

I got my card a week later and after my marriage i just applied for a replacement and got a new one.
