Our case has been referred to consular for further review

Timeline

After a nine week delay due to an un nessarary medical test, my fiancee finally got her interview on July 11, 2008 at the US Embassy in Manila, Philippines. We have filed for a K1 fiance visa.

The pre screener did not take any of our mountain of evidence that we had gathered together. IE Pictures, reciepts, emails, yahoo messages, bank statements, employer statements, ect. They only wanted the tax returns and the affidavit of Support. They didnt even take the letter indicating that we were represented by an attorney.

Anyways,

Her interview lasted maybe 10 minutes. I was not there. The lady told her that she needed to review our papers. She was givin a pink slip and a white letter. The white letter did not indicate anything on it. It had none of the boxes checked for further documents needed ect. It only said wait till you hear from us. The interviewer told her to wait for her name to be called.

Her name was called and at this point she paid for the delbros visa delivery fee " We Think". They also kept her Philippine passport.

Anyways,

We had hoped that since the medical test had caused us a nine week delay that we would get the visa right away but instead we are experiencing and additional delay. I have called the 888 number and Keep getting the same girl. The last time I called she told me that OUR CASE HAS BEEN REFERRED TO THE CONSULAR FOR FURTHER REVIEW.

DOES ANYBODY HAVE ANY INFO ABOUT THIS?

I am 54 and my fiancee is 28. Does age difference matter?

What further review could they possibly want? They didn't ask us for any further documents.

it might just be the document verification..they verify her CENOMAR at the NSO...but let me clarify it first...did u pay for document verification at metrobank before her interview? thats supposed to be 650 pesos...i think that must be it but i can be wrong also..good luck! :star:

Love is an unexpected thing...and when it arrives grab it with all ur heart....it may pass u jsut once.......

01.23.08 : NOA1

04.21.08 : mailed I129F

04.22.08 : NOA1

05.14.08 : NOA2 both for I 130 and I 129F

06.26.08 : medical exam 2nd day PASSED!!

07.09.08 : interview day! PASSED! PINK SLIP!

07.15.08 : visa on hand!!!

08.01.08 : POE SFO (home with my papi!)

thank you, yes she paid the document verification fee and the delbros said they sent it already to the embassy back on april 21 her original interview was scheduled for april 29 but was delayed due to additional medical test. it was resceduled for july 11 but now I am wondering if the verification got lost in the shuffle because of the rescheduled interview

I hope that you have a speedy approval.. I am not sure if you were around when Zandy and I was in AR for nearly 6 weeks.. but.. when you guys are finally together.. all of the AR ####### will be a distant memory. I wish you guys the best.. Mike and Zandy

Thanks for your reply, all replies are appreciated cuz as you know the embassy gives you little or no information at all. I think that is the hardest part is just not knowing anything and not being able to plan.

I can imagine the frustration, but all you're going to really know at this point is that its under further review. That has happened to some where the CO conducting the interview felt the case needed a closer look...that's all. The interview is much like a job interview and if your fiancee was nervous and just didn't interview well, that could effect the outcome. I wouldn't worry yourself...just wait for their decision and if they deny the visa, you can appeal.

The age difference could have raised a red flag. Someone else mentioned this in a previous post recently, I cant remember what the thread was. They're probably wondering what you could possibly have in common.

I've noticed from reading posts that a lot people here think the interview is a mere formality...it is not. You can't just go there, lay your evidence on the CO's desk and say, "Here's all the proof you need." The beneficiary has the burden of demonstrating that the document evidence is consistent with her explanation of the relationship and answering the CO in a way that helps him/her determine that. It's best to go into that interview with poise, sincerity, openness and honesty - to leave a good impression with the CO.

I agree that it's none of their business, but unfortunately it does matter what they think. They're the decision makers. But Good Luck!!

I second that. USCIS makes the final decision, they need to be impressed. You are at their mercy.

yes, I know we are at thier mercy. I think we have done everything to try to impress them. This is everything to us. Its very hard when your future is in the hands of someone else's opinion. It not right for another person to decide whether or not two people love each other and want to get married. That is a decission that only the two people that are getting married can decide. That is all am trying to say. This is America we dont let others decide for us whom we will or will not marry. At least thats the way it is the last I heard. I appeciate the replies. Thank you very much

Again, I understand your frustration, but this is an immigration matter so it does matter what the USCIS thinks about the relationship...whether it is a bonafide relationship or not. It would be a great world if nobody committed fraud, but that's not reality. Hang in there and hopefully your visa will be approved upon further review.

Again, I understand your frustration, but this is an immigration matter so it does matter what the USCIS thinks about the relationship...whether it is a bonafide relationship or not. It would be a great world if nobody committed fraud, but that's not reality. Hang in there and hopefully your visa will be approved upon further review.

No, its not fair that another person/agency should cast judgement on us and determine our happiness, but thats the FACTS, and due to fraud (which is plentiful) they have to be suspicious.

No, its not fair that another person/agency should cast judgement on us and determine our happiness, but thats the FACTS, and due to fraud (which is plentiful) they have to be suspicious.

Its really hard to say what an individual is thinking. I really dont beleive it is our age difference that is causing this reveiw, but it might be. it just hard to say because they really dont tell you anything. They just leave you wondering/waiting it really really stressful. But am sure everybody knows that. Nothing about this is easy.
