I-130 Approved (Consular Processing) - Next Steps?

 Share

I am a naturalized Canadian citizen, born in India. Recently I got married to my gal (a USC) in California and moved back to Canada to wrap up the last two semesters of school. I work full time and go to school part time.

We decided to go through the consular processing route and she filed I-130 and G-325A forms in the US.

The I-130 forms got approved yesterday and an approval notice was sent too. As per my knowledge, the Montreal consulate would contact me in two months.

Are all the steps that we have undertaken the right ones ?

Also, I am wondering as to what would be the next steps? What forms or other documents do I have to fill up? Just trying to be a bit proactive here ;)

Hi! Have you read the guides on here? If you filed just the I-130 (no I-129f), you should be getting an IR1 or CR1 visa (probably CR1 if you're married for less than 2 yrs by the time of the interview). Also, if your paperwork was filed at California Service Center, then you are doing consular processing, but not DIRECT CONSULAR FILING (there's a difference, and DCF only applies if your I-130 was submitted and approved at the consulate itself).

Also, there should be a stage where your paperwork goes through the National Visa Center. Check the guides for IR1/CR1 visas. You'll need to send in a series of fees and forms at this stage. IF this is the visa you're applying for, I highly recommend James' shortcuts because they really speed up the NVC stage. After that, they forward your paperwork to the Montreal consulate and you wait for your appointment. In our case, we've finished most of the visa center stage in about 2 weeks using the shortcuts and are just held up on the last form due to some complications in our case. It just takes careful research and some extra effort, but it's worth it!

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

CRBA filed 1-3-13 at Seoul for our daughter

Well I have gone through a few guides here, but yes not all of them. Will have a look at the links you provided.

If you filed at the CSC your case will take between 2-7 weeks to reach the National Visa Center. Please read James' shorcuts found in the NVC forum in one of the first threads named "Timesavers", all the info you need is in pages 1, 10 & 11. Even if you choose not to follow the shortcuts, they will give you a better understanding of how the process works at the NVC.

Also, try to read the threads found in that same forum where some people have gotten their IIN from them NVC and been able to pay their bills and printed their forms online. This literally cuts the waiting time at the NVC by almost ½.

Good luck!

Diana

Joey -- please start a new thread and post in the IR1/CR1 forum. You aren't filing for DCF, and you will get better answers if you ask in the appropriate forum. Good luck!

Evamae -- same advice as I gave to Joey above. This is the wrong forum for you to ask your question, as you are filing for a K3, not DCF resulting in an IR1/CR1. Please post your question in the NVC forum which you can find here: NVC forum

Sorry if this sounds harsh, but you will not get an answer here as none of us DCF folk deal with the NVC.
