I am waiting for the interview of IR1. I was just informed that the interview had been scheduled on 19th Aug, in Stockholm, Sweden. But just after I arranged the medical examination and bought the ticket to Stockholm, I got a letter from the embassy saying that they are going to postpone the interview unless I can submit evidence that I am citizen of Sweden or have permanent residence. I am not Swedes, I don't have the permanent residence either, but I have been living here for 6 and half years as a PhD student. I pay tax since 2002. Sweden is my residence country, that's why I indicated Stockholm as the embassy of interview in the I129F form. We even asked a senior officer of USCIS if my visa could be issued in the country that is not my nationality, the answer was yes.

But now, but now......I don't know why nobody told me earlier, I don't know how to persuade them. I called NVC, the operator was a bit surprised and asked me to send evidence to them to show I am legally living in Sweden for many years. I sent everything I could find, including my tax records from 2003 to 2008, my residence permit from 2001-2008 and my population register page showing I moved to Sweden in Jan 2002. I will know their decision tomorrow. I am very upset. I had thought I would be together with my husband by end of September, but now everything is out of control. I am from China mainland. If my case were returned to NVC, I don't know what they will do and how long it takes. :crying::crying::crying: The document processing programs are also different from Stockholm and Guangzhou, China.

How can I persuade the embassy in Stockholm to accept my case? Is it helpful if my American husband calls them? :wacko:

I would have your husband try to call the embassy.

Where were you married? Because, that is where the interview needs to take place, unless it was the US. If you were married in Sweeden, then your resiedence should not matter. There have been people who went on a vacation and got married then had to return to that country for the interview.

But I would have your husband call the embassy.

I am sorry to hear your case.

I think your husband as american citizen should call the US embassy and try to confince them that you should be able to have interview there and before already asked with USCIS and USCIS confirmed it . also You or your husband need to provide them all necessary documents that you have been living there.

if it wont work , go to congressman or senator to help.

Your case almost similar with me, I am indonesian but I have been living in Hungary for 5 years and we set up interview in Hungary and my husband already asked before to USCIS that it is ok if I have interview in Hungary , that's why case number was assigned with BDP mean Budapest ( Hungary).

But my case is in NVC still, waiting for review documents.

I would call the embassy. But, I am not sure, but if you got married in China. They might make you do the interview in China.

But call the embassy.

I would call the embassy. But, I am not sure, but if you got married in China. They might make you do the interview in China.

Hi ,

Please check again the histories of your case , if you have I-129F approved then you are applying for K3 Visa, and the interview place will be in the country where the marriage took.

But if you have I-130 Approved means you are working with CR/IR then you should be able to interview in Sweden as your current resident.

So if you can find the law , or Uscis statement about this , you can show to US embassy.

My I-130 has been approved. My category preference is IR1. Unfortunately we don't have any evidence of the answer from USCIS, because my husband just went and ask. He doesn't remember the officer's name either...... :wacko:

The embassy refused me because I am not PERMANENT resident of Sweden. They said they need a permanent address to procede my case. But my contact address is always in Sweden.

I called the visa specialist of Department of State also. The answer was if that's a busy embassy, they may say no to me.

USCIS website states that for K3 visa you have to appear in the same country where the marriage took place...I dont know what idiot operator told u that u can pick the embassy...As someone mentioned bfore, many people have gone to get married in another country thinking its romantic, later to find out that its going to become a living hell when applying for a visa later on...I wish you all the luck and hope things work out for you.
