Hi All,

I've been married to a USC man for just 7 months, the marriage didn't work out because he is such an abusive man. He is so paranoid and so insecure that he thinks I'm only after for the green card. So as to make my story short, can't stand the abuse so I went back home to the Philippines without any help from him, before our AOS application will be approved, just to prove once and for all that I'm not after for any green card. I signed the divorce papers without any hesitation and now we are officially divorced, thank God, I'm free at last.

This is a long shot, but who knows what will happen in the near future. Correct me if I'm wrong, that my ex can't petition any other woman until after the 2nd yr of his approved petition for me before, right or wrong? Will it also apply to me, that no USC man can petition me until after the 2nd yr too?

And do I have to do send some kind of letter or forward our divorce papers to the Immigration to stop the processing and clear my name or just leave it as is and wait for the rejection notice. Please advise what's the best option here.

You won't really be free until you can forget about him, too bad our brains aren't like the RAM in the computers where those bad memories can be deleted by wiping those nasty files from our brains. Never heard about a happy divorce, but always the first time, but there is a lesson to be learned by them as well in choosing a new mate. You are wiser now, use that to find the right guy and forget about that jerk.

May also call my ex wife a compete jerk and felt that way for a long time, but realized the chemistry between us, chemistry can make the the most delicious meal in the world or can result in a huge nasty explosion. If you think back on your relationship with your ex, would be signs where the two of you were chemically explosive. Thinking back, I was an idiot for marrying my ex, just too many doubts and this doesn't mean she was a bad person, but the two of us together was a very bad combination, she was also an idiot for marrying me. We have about 3 billion choices, pray that you meet the right guy this time and leave the past behind, will only make you bitter.

Or call me an idiot for giving this advice.

It was your AOS application, so I'd think you could write and advise them of having left the country now that you're divorced and you will not be continuing the process.

As far as further petitioning, my understanding is that he could apply for a K-1 within the two years, but not without an explanation. From what you've said, if he was to petition again, he would just have to fill out in his application his previous marriage, divorce, and he could write a covering letter saying that you two weren't compatible, which from the sounds of it, that's what you were.

Neither of you have to wait 2 years for anything.

Are you gearing yourself up for another petition already?! I guess what I'm trying to say is you could fall for someone in the same country as you (you never know)! I think the petition would take care of itself as void. You've already left the US so it shouldn't be a problem. You'd need to get the final decree with the judges blessing from the state in which you got married (I read that in another forum).

In a way you are right, you can't be totally free especially if you can't forgive. It's hard to accept especially in my case that for the first 6 mos, i was like a maid there taking care of his mom, and I'm sure that was his only purpose he got me there, because everytime i put my foot down, he just told me to go home, it's so sad really. I was doing well with my profession before he came into my life. I don't need any greencard to exist. What a waste, it's so hard to start but life must go on, have to look forward to a bright future and hopefully I can find someone who can see and love me as me.

No, I'm not. I was jus thinking ahead, that it is possible. I already have my copy of the divorce papers. Just got divorced for more than 1 month, it is just today that i have a clear mind about my situation and it just occured to me the "what ifs" and have to make sure I'm not bind for any legal predicaments in the future. Thank you so much.

He can petition again by writing a letter asking for a waiver. You can be petitioned for again at any time. No worries here.

Does any of you have an idea where to send my letter of withdrawl, will it be to the Chicago Service Center where we sent our AOS or to the local office which is Las Vegas in my case.

You know, I'm really not sure. Unless you know your file was forwarded to the local office, I'd just say to send it to Chicago and they will either enter the information or send it to the relavent authorities. Makes sure you put all the identifying information you can on the letter for them to better find you in the system!
