Traveling to US after I-130 petition

My husband will file I-130 at the US embassy Japan in a week.

My cousin suddenly decided to have her wedding in Guam in October,

and we are going to attend it if it doesn't cause a problem on our immigration process.

I am wondering if it is safe to travel to a US territorry with VWP after I-130 is approved.

I thought bringing the approval letter from the embassy,

proof of employment in Japan and a return ticket would be sufficient for an immigration officer at the POE to let me though, but if you have some more advice, please let me know.

Timeline

There is no rule that says you can't travel on the VWP with an approved I-130, however it would be wise to bring as much evidence as possible proving strong ties to Japan. If both you and your husband live in Japan and your are actually doing DCF (as indicated by your filing at the embassy) that could help as well. Though I am not sure that this would be as much of a concern when dealing with a territory verses the actual US. Still, better safe then sorry. I would also bring along a wedding invitation.

If it helps any my wife came to visit me after our I-130 was approved and we didn't have any problems. Many people have done this and only a few seem to have been denied entry at the POE (which does not affect your immigration case, it is not the same as being deported though you will likely be asked about it at the interview).

Also, as awful as it would be to be denied entry on the VWP, it wouldn't negatively effect your visa process.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
