I have a marriage Certificate is that what i make a copy of and send for the AOS or do i need the certifed copy from the court house. I read in another post and it was said that the marriage certificate is not what AOS IS ASKING 4 but instead that they want the offical certified certificate from the public records that the court house on file. I would think that the marriage certificate is the same thing that the court house would give me. The marriage certificate i have has my wifes maiden name on it and does not have her new married name on it i don't beleave the certified copy would be any different.

I've never seen any marriage certificate, license, original, copy, certified...call it what you will, that ever has anything other than the wife's maiden name on it. The "proof" you need of your wife taking on your married name is the marriage having taken place. Period. All new forms need to be filled out in your wife's new last name from this point forward.

Not true. In NY, when you apply for a marriage license, there is a line for what name you will use for your married name (can be same as maiden name, hyphenated name, combinations of the two. The marriage certificate when issued shows the married name, and can be used as proof of name change. Getting married does not necassarily change your last name. I am sure it is the same in many states (maybe not all, but many).

In NY, if your marriage certificate has your maiden name, you cannot legally use your husbands surname without getting a name change.

Thanks for this very important information Urge! I wasn't aware of that. There are daily threads on here about how to go about changing your name after your married...and I wasn't aware that NY had something different. I wasn't meaning a woman has to, or that being married automatically means she has changed her name, just that if she was going to use a new name after marriage, if you are in say Missouri, where I'm from, then all you have to do is apply for documentation in the name you now wish, and show your marriage certificate to prove that you were married.

My marriage license has my maiden name (I got married in NY) but the lady checked that I will be using Nick's last name after marriage.

I hope that my marriage certificate reflects this cause I am not going to be legally changing my name, that is insane! I just want to assume his last name but still have my birth name on my birth certificate.

My advice is never send "ORIGINAL" copies cause most likely you'll never see it again,

just make and send copies of everything.
