How long does it take to get AP after RFE was submitted?

My case is at MBC since May 9. Our lawyer told us 40 days later (July 23rd) that she received RFE for I-864 (June 13). She would not said even then if I did not ask her why is our request for expedited AP denied (in an email, CRIS mentions that initial evidence was missing and letter sent to us on June 11). I never got the RFE letter.

In a day (July 24) I gathered all our docuemnts for I-864 and sent them by Express mail to MBC. They received it on Friday (June 25th). I called today and actually spoke to an immigration officer. He told me my case will resume without me filing for new expedited AP. So, why the email from USCIS says "Your case will be held in suspense until we receive your response. You may request EXPEDITIOUS processing again once the Service has received your response." The person on the phone was actully very aggravated that I even bothered to call.

Thanks,
