Where to File K3/K4 Petition

Timeline

Hello all,

I am curious as to where do I file my K3/K4 visa petition. I was married overseas in Thailand, I read in the instructions according to the Life Act to apply in the country where we were married but then towards the bottom of the instructions it says to file it where your I-130 petition is currently being processed (collecting dust not processing). If anyone could assist us we'd greatly appreciate your assistance. Thank you

It depends. If you live in the country you were married you can file dcf (direct consulate filing) otherwise you send it to the Chicago lock box and they foward it to eather Vermont or California, it all depends on were you live.

04-12-08 Married

06-11-08 Mailed I-130 Package

06-18-08 NOA1

08-08-08 NOA2

10-22-08 Interview USEM

10-28-08 Visa Received

11-01-08 POE

That was fast!

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

Thanks, you know I'm jealous of your timeline, I mailed off my petition a day after you, they received the petitions and cashed my checks, I still haven't received my NOA1. I called and received my receipt numbers but that's as far as I got. Anyways thanks again for the reply. Have a good one and good luck to you on your case!

your K3 is composed of I-130 and 129F. If your filing for 129F then you could submit it where your I-130 is pending so you could waive payment for that.

2007-09-19: Marriage

2007-12-31: I-130 Sent

2008-02-14: I-130 NOA1

2008-02-28: I-129F Sent

2008-03-07: I-129F NOA1

2008-05-06: I-130 & I-129F NOA2

2008-06-25: Interview Approved (Conditional)

2008-07-08: Forward Additional Doc

2008-07-15: VISA Received (2yrs Validity)

2008-09-03: Flight to Cincinnati, Ohio; POE SFO

2008-09-06: Travel back to Chicago with my hubby

2008-09-29: Mailed I765 (EAD)

2008-10-07: NOA for EAD

2008-12-12: Received EAD Biometrics Appointment

2008-12-19: Biomentrics Appointment

2008-12-29: Ordered EAD Card

2008-12-31: EAD Approval

2009-11-26: Submit AOS

2010-03-30: Permanet Resident 10yrs GC

2010-04-15: Update status with SS

2010-04-22: Received new SS Card

your K3 is composed of I-130 and 129F. If your filing for 129F then you could submit it where your I-130 is pending so you could waive payment for that.

I already sent the I-130 to the Chicago lockbox and they forwarded it to the Vermont Service Center. I guess I will be sending the I-129F to the Vermont Service Center. I didn't understand that whole Life Act thing, it kind of contradicts the where to file portion. Thanks for your assistance.
