What is the deal with K-3 at VSC?

I don't get it.

Over 20 I-129F NOA2s for K-1 in the last week

Only 3 I-129F NOA2s for K-3 in the last week.

I realize there are twice as many K-1s, but if things were done fairly, there would be 10 I-129F NOA2s last week for VSC. If you look at it over the last month, it is even worse.

Done for 3 years or 10 years. Haven't decided yet.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

From what I heard from the USCIS director s office the K1 ( fiance visa) is a much simpler process that does not require much processing neither a real profound assurance of the bonafide of the relationship and internal investigation of each party... While K3 requires proof of bonafide marriage and it is a much more extensive processing since they will come and stay, they have now decided to try to process both I-120F (K3) and I-130 togethers, and hold the K3 s there are solely pending on the I-129F until the I-130 is adjuticated or ready to be adjuticated...

It does not make much logical sense to me... but I have heard this explanation from my senator, to USCIS customer officer assistance and also from the USCIS director s office...

Good luck to all of us waiting on VSC snale pace...

Anybody out there considering getting married and going for a K-3, forget it. Go for the K-1. I know K-1 folks are gonna say they can't travel without Advance Parole, and you only have 90days to get married etc. I would gladly give up the multiple entry and deal with Advance Parole to be with my wife right now.

Its my understanding the K1 visa applicants plan on staying also..and they may or may not get married. what's simple about that? K3 applicants have already proved their intentions, and the whole idea of the K3 VISA is to unite families that would normally have to wait long period's of time for the I130.. so that makes sense how???

yea, but it still doesnt make sense with

CSC approving K-3's in 2 months time......

hi,

i'm so lonely right now, cuz' me n my husband filed our I-130 since last year Sept 2007, After we got married we processed our the petition of I-130 right away..I went home here in U.S. so I could file the affidavit of support like it says about K-3 visas. My husband is left in the philippines and it's really hard being far apart, I kept on thinking if I should have just waited there until approved but the problem is no NOA( Notice of Action) ...And its been a year now since we filed. No Notice of Action is received, but a receipt # has been received..I hope we don't wait for two years..how come K-1 visa just like my brother and his fiance are faster, They are here now in the U.S together and I believe me n my husband file our I-130 before them...How long should we Wait????

I agree with you that they seem to be operating on the premise that they can do less due diligence on the K1 vs the K3. But their logic is erroneous all over the place. If they gave them the visa easy and then scrutinized their AOS for K1, and did the reverse for K3 (more checking before visa, but a simple AOS) I would say the USCIS is at least logic. But wait till AOS comes around. K1s (who got USCIS approval of their petitions faster) get their AOS forwarded to CSC and approved without interview. K3s (who had to wait longer for original petition approval) have a harder time with AOS as ours are forwarded to local offices for interview. Depending on local office backlogs, that can take 4 months to over a year!

So K3s have it worse all around.

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview
