Actually, you can sue USCIS under code 1447B. They are supposed to process applications within a certain amount of time. Many people have used this to sue for completion of their citizenship. I was on the verge of doing so when my citizenship was approved after 2 and a half years. I believe it is the Act of Mandamus or the 1447B. Look into it. USCIS has to answer for their actions to someone.

Yep, but you'll have to wait a year to just file, after that they have like 90 days to respond, and then another 60. But you dont really sue them. More like Disciplinary actions against indivduals who work in USCIS/VSC.

They can get away with murder. Look at their processing times. Sept 3rd 2007? And they move when want to move. It was stuck on July 30th, for like 4 months. So as long as they have those times to cover their asses you cant do anything to them.

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

That's not necessarily true either. They have up to a certain time and i believe it's 120 days to complete an application. It doesnt' matter really about their processing times. This is why, they started trying to get people that went for citizenship interviews that are pending a namecheck to sign a waiver that they wont hold USCIS responsible if their processing times are over 120 days. Some people signed but some did not. So, a lot of people started suing under Mandamus and 1447b. This is why the huge movement for N400's that and plus, it's election year.

I have hope for all of us though because being apart for so long will only make us appreciate our spouses even more.

its beyond the point where they have to stop using the N400 fee increase as an excuse. they raised the fee last year in july...dont tell me they cant process applications in one year..earlier it used to b about 7 months or so to get ur citizenship...even if the applications doubled they shud have caught up by now...N400 fee increase is just a buffer they are using to defend themselves..they dont have an excuse now given that they have also hired 1500 new employees as they claim to have.

I'm worried that this has taken so long that the consulate will either delay or reject her visa application because I haven't been in China in over a year. I expected to have gone back by now but the long processing delays and money concerns have prevented it. I am thinking on going for her interview but if she gets a blue card, consulate RFE, then I may have to go back to US without her and it could take awhile for me to be able to go back. She may have to fly for the first time by herself and that would be difficult for her.

120 Days for N400 or for Every application/petition.? It wouldn't make much sense having same amount of days for different petitions. Some are easier to complete than others.

It's strange but when i saw the updated processing times, i didn't feel comforted at all. To me, it just kind of felt worse. I have been trying to avoid al this because i needed to take a break before i loose my mind. anway, in a strange way, when they were processing out of order i felt a little bit of hope. I guess i was kind of hoping that mine would be processed suddenly out of the blue. Now i have no hope really. Cause all i can think is my gosh, they are only at Sptember 3rd.

sorry if this would sound sircastic...uve waited all this long...i think u shud not look at how long ur case is going to take...u can look at the other way...if they move another month every month for the next two months..u have a reason to call their lazy @$$es by october and yell at them for sitting and doing nothing...also demand that ur cases gets a priority or ull hire a lawyer and sue their lazy @$$es

i sincerely feel your pain..

I know a friend who was waiting for his oath after successful interview for citizenship. He waited for over eight months wrote to USCIS several times and eventually hired a lawyer in Chicago and sued the USCIS and LO...he got his oath in two weeks. I will try to find the name of that lawyer in Chiago.

I have just received a call from Hillary's office and they said that will contact VSC to find out my case status but I told the rep that is not even about my case I'm concerned my major frustration is about the delay in comparison with CSC and she said we know is crazy but we will fight for this. so hopefully this will be good news for all of VSC filers! lets keep the hope :)

When did you receive NOA1? I am wondering if I should do this though I have heard others were told that their senators/reps couldn't do anything until 6 months after their NOA1 date had passed. How did you contact Hillary's office, by email?

I too am a vermont victim...sent my petition november 2007... received noa january 2008 and have the last update stuck on the same 2/24/2008 as quite a few others do...very evident we are all feeling the same fustrations...with this being my first post, i just wanted to say..this site rocks!...have learned quite a bit...

Yes I think VSC are idiots but it was Chicago that caused the initial delays. I sent my application to VSC and they were so far behind with data entry they sent it to Chicago. Chicago, instead of giving me an RFE for the missing signature, rejected the application. Then they rejected it again to get the higher fee out of me. :angry::angry::angry:

Finaly they accepted the application but it seems I got sent to the back of the line and got a Feb. prcessing date instead of August. So now I am waiting over a year and have to worry about additional problems due to the long time we are apart. It is a good thing I have a bank account with her name on it which should help but I think I am going to have to be there for the interview or risk her getting rejected due to being apart for over a year. :crying::crying:

Lets draft a letter and send it to NY times. I have seen articles in NY times have blasted USCIS/VSC for different type of wrong doings that effect people's lives. Hopefully if it published that can make some difference. I really wonder if any VSC employee look at these boards. Otherwise things would have improved by now. The whole system is so F#### d up. This is the only country where citizens are made to suffer!!

Ive sent 2 letters to NYT, none were published. What you need is lots of people behind you to support a large problem thats with VSC/USCIS. But the large amount of people never ends up showing up.

i feel your pain...i encontered the same situation when i did my citizenship..i forgot to sign the check when i sent it...they sent the application back to me and i had to reapply...they dont hold the spot for you, its just like reapplying..i would suggest that u b very careful in the future with how u send things and what you send...also make sure 10 times before u send something that u r sending the correct info...spending that extra hour or two to research something is worth than getting yourself pushed for another few months...i sincerely hope that u get ur approval soon..

as far as your concern of not seeing her for a year would cause a problem, i dont think that shud really b an issue....that is not a ground for visa denial that you havent visited ur spouse in a year...USCIS understands how life in america works and how a few days of vacation time could cost you your well established job. they have to have a strong reason to deny her a visa, not just that u havent visited her in a year..
