Can F1 student(intending immigrant)'s income be used in I-864?

Hmmmm see that's tricky. I say include it, the worse that could happen is you get an RFE for more information. But technically it's legally earned income.

I'm an incoming PhD student this semester (but with no EAD card yet). Most people say you give up your F1 status when you apply for AOS but the school always requires you maintain it and the advisors say if the AOS doesn't work out you could stay on F1. It's really just a gray area. Most lawyers themselves don't have a definitive answer.

I have a constant income of 20K per year. And I got RFE for not sufficient funds..

Hi, Sorry if I ask a dumb question:-) I think I got similar condition as you do in terms of stipend income, so hope you could give me some clue... Could you please let me know whether I should include my TA/RA work from the stipend income in the column of 'Applicant's emplyment last five years' in the G-325A form? And if so, do I need to provide any document regarding this matter? (P.S. I won't use this income in I-864, just wanna know whether I should include it as "employment" history - since F1 is not supposed to have any employment history during the study, though the TA/RA job is on-campus and is absolutely legal, but I was just a little worried about whether this "employment" history would "confuse" USCIS if I put it in G-325A)
