HCMC Viet Nam Visa denied

Hello every one.

My fiancee had her interview at the HCMC Consulate on Thursday the 24th . We thought our documents were really well prepared. We 've been through every thing several times, made sure we had everything in order. We also have ME is our lawyer for the case from start. We had plenty of evidence and it was well documented, my fiance listened and practiced sample questions prepared by ME, but after the interview, she came out with a blue slip. Here is list of what US consulate in Ho Chi Minh asking for:

1-petitioner: Please provide the full name , current address, and date and place of birth of your ex-spouse. Provide evidence of his/her current address. Also pelase indicate when your ex spouse immigrated to the united states. Did he/ she imingrated with you? Did some one sponsor him/her? If so, whats their name? Did she come to the US by boat? If so please indicatewhen he/she left Viet Nam. Through what camp he/she immingrated

2- Applicant: Please provide the full name, current address, and date and place of birth of your ex-spouse. Please provide evidience of his/ her current address

3- Petitioner: Please provide us with a proof of the airlines tickets you use to visit Viet nam. If the ticket were purchased with a credit card, please provide a copy of statements showing who purchased your airline tickets to visit Viet nam ( copy of statements are available from credit card company ) . Each staement need to clearly indicate the name to which the credit card is issued , the purchased date and cost of purchase. If ticket were purchased with cash , please provide the bank statements of the withdraw include copies of the three months priors to and immediately following the purchase. Submits for all trips to Viet namthat you visited your fiance spouse. We do not want the receipt you were given by the travel agency. Submit a letter of explanation if you were unable to provide this documentation.

4- Applicant: Submit a list of all of your relatives in US . For each invidual , please list they full name, other name used, date of birth , current address, address for the past 5 years, relationship to you, date of immigration to the US , measn of immigrations to the US, and any contact/ relation ship they have had with the petitioner or anyone the petitioner is related to. Also submit each of invidual’s residency or citizenship status.

5- Petitioner: In a sworn statement, please provide a list of your previous address for the past 10 years. Please list all persons who have resided with you. Please explain if any one you have resided with is related to beneficiary;

I had everything done and notary all documents, I will Fedex to Viet nam by Monday, I will update my case later, hopefully Mr ME can help us push the case go thru . I have all my question up here so who ever have coming interview day know what you should expect to have and prepare with your interview, try to think that if missing one of these documents will be a big trouble thing for your case. I dont know if any one else has the same situation? can we share?

You and your wife both had divorced. CO maybe think that's a sham case. I know one case, they else has the same situation. After she submited all documents what US consulate in Ho Chi Minh asked, they issue a green slip inform that the file will be return to USCIS.

I think you need help from Mr.ME.

ME is our lawyer , ME work on my case before the interview, we are still working on it. You must be misread that part I was talking about. I was divorce on 2002, its was 6 years ago and we had evidence of relationship almost 4 years from now.

My fiance sent to me by e-mail all ddocuments had notary they require, then on 25th July I came to embassy to submitted. I came there from 13:00pm and waited until 16:00pm, they called my name and give me another BLUE Slip, not asked me anymore questions.On this Blue Slip, they requested " Please submit Letter of explanation regarding beneficiary's previous marriage as well as how and when beneficiary's ex-husband went to the U.S. Please explain If petitioner is acquainted with beneficiary;s ex-husband"

Now I don't know how can I write a formal Letter of Explanation of that. Because I don't want to CO return our case to US. I need everyone here help, please give me a Sample of letter.

I think this is the situation, may be you and your husband's marriage just a fresh terminated, US consulate might think petitioner known your husband, your divorced may be a fake one, they might think you and your husband will reunion in US , and petitioner nothing else but your ticket to US. It was happened alot in the past , thats why they want to assure if your ex-husband and petitioner is acquainted. You can call Mr Marc Ellis to see if he can help, he did help a lot of hard cases in this forum, and I aslo have him on behalf of me for our case. (0908433448 you have to talk to his Viet Namese assistant first before set appointment to see him )

In my case, I was divorced 6 years ago and my fiance was divorced on 2005. I dont know her ex-husband and I never live with her family, I only know my fiance thru her sister , and her sister is a friend of mine. I have 40 months of email exchanged, phone call records, letters, picture and engaement ceremony too, I did go back to VN total 4 trips to see my fiance and All my tickets has been bought thru my bank account, I work in same place for almost 10 years and my income is very good, I hope this is the last stage that we have to go thru.

They require here " Please submit Letter of explanation regarding beneficiary's previous marriage as well as how and when beneficiary's ex-husband went to the U.S. Please explain If petitioner is acquainted with beneficiary;s ex-husband ".

Actually I don't remember what's year my ex-husband came to U.S? I just known him come there with his family by HO Visa.

I divorced on Oct 2007, my fiance divorced on Oct 2003.

I and my fiance met online, and he has never known him my ex-husband before. The consulate officer think he will bring me for him.

In your case, how much does it cost from Mr. ME? Let us know to arrange money for that?

You have to call that number to talk to his assistant, I think each case the fee is different, normally after the blue slip there will be another slip that said they need more time for your case or they dont belive in your relationship, or pink but this one just ask for more information, it better than other ( just my 2 cents ) if you decide to to it your self then you must find out and answer all the question, if not it will send back to the state, my best advice is talk to Marc ellis to see if he can help. In my opinion, blue slip better than green slip....

The color of slips is not important. The content is important than the color. One of my friend was give a green slip write: Please submit your medical examination your results. And when she submited she got pink slip immediately. Is it bad than salenahuynh's blue slip?

I think green slip require things ( documents) from only applicant or don't require anymore, applicant must come home and wait. Blue slip require things ( documents) from petitioner (major) + applicant ( minor).

Hey Phillipt,

Sorry to hear about your case, but you'll be fine. Just take longer than other. Our situation was similar to yours. I believe the ex-spouse info is almost routine at HCMC (90% of cases are delayed for this reason.) They asked me for the same thing although we had everything during the intial interview and they did not look at them. I wrote a long story about my ex-spouse and how we broke up and sumit along with 129I. I just did not have evidence that we lived in separted places to present to the CO during the interview.

Make sure you have your ex-spouse ultilities bills, gas, electric and phone bills different than yours.

Hi Phillip,

I second what menyoo told you. IF you are divorced, the consulate must have proof that you are not co-habitating with your ex-spouse, that is why they need proof of ex spouse address and/or other evidence to show that you are separated and living by your own means. ME even confirmed that is what they look for also.

I know how you feel, I was in the same boat myself...

I've mentioned this before, but I think for future K-1 applicants, if you can, please coach your fiance(e) during the intial interview that you have the evidence for ex-spouse evidence and address, list it in your evidence checklist and maybe this might prevent you from being blue-slipped at the interview.

Guy&HOa, I think your advice is very helpful. If I had known it before my wife interview, my wife might have got a pink slip. Now we have to wait and wait after submit required document.
