I'd get another job first. Your current company will have no problem finding a legal loophole in ending your employ. Would be safe to have something lined up before making waves. Just my opinion.

That was my thinking with going to the labor board or a lawyer. but going to HR to ask for an investigation isnt asking too much imho, they have to know that they mishandled it and could have more liability by not following up on her request.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

If it were me, I'd go to the HR dept. and then if you get no where, I would file a complaint with the labor dept. The labor department will probably be the best place to start. But thats me!

07/21/11 filed AOS off tourist visa

07/28/11 USCIS cashed check

07/30/11 Recieved NOA1 and Biometrics letter

08/24/2011 Biometrics

08/25/2011 RFE sent to us for some info we've already sent in

08/30/2011 sent in the rest of info USCIS asked for

09/13/2011 went to congressman's office to sign papers for expedite of work permit, due to financial hardship

09/15/2011 Work permit expedite approved!! He can finally find a job!

09/24/2011 work permit arrives

09/26/2011 Apply for social security number!

09/30/2011 Letter is sent for interview

11/07/2011 INTERVIEW!!!

Its 2012 and still no approval! Still waiting

01/27/2012 Letter sent stating that file was sent on for more review :(

Amanda.. I'm really sorry you're having a hard time at your job.. No one should do that to anyone.. That is plain plain hateful and mean.. Be sure everything happens for the best and may it is time to move out of a discriminative environment.. Go for your the position that is waiting for you.. You are in my prayers and mind to have your right back at least an apology to you and your husband.. *hugs* (F)

Good luck and I'm glad you are taking some action! I have been hearing horror stories from different people lately, and employers need to be more accountable as to how they treat their employees. This is just wrong.

I just read of your situation at work. I agree with all the suggestions made. Definitely apply for the new opening (you already did - great luck and blessings!). And contact the labor union and definitely get some lawyer consults (I hope you hear from the ones you contacted already). It's very good to keep every evidence and record you have. Maybe if your co-workers who were involved in that conversation do not mind, have them write a quick note that backs you up regarding the claims. Do you have any sort of evidence regarding your co-worker bringing in her husband? I suggest maybe if there is a guest book kept at the receptionist, get a copy of that page.

I understand its stressful, disencouraging, and you're ready to leave. Just definitely take care of what needs to be done. That kind of record should not be kept on your file, especially as it was unfounded (HR obviously did not follow up with you in the proper procedure).

Lisa....they wrote me up on my behavior...not that I was socializing outside of a break time, just the fact that I "said something" to scare someone. And seriously that is what ticked me off the most that someone was listening to a conversation not directed at them, then went behind my back and twisted my words. I really feel like somone is just out to get me here. Like, what did they think would come of it???

Sharifah...thanks so much for the prayers! I do feel like God is opening a door...I e-mailed my old boss and sent her my resume and asked her if she would consider me for the position. I also e-mailed the woman who is about to leave the position to give her the heads up and she said that they would probably love to have me back. I worked with spanish speaking clients and still...almost 2 years after I left there, the clients are calling asking for me!

Star_dragon...you are absolutely right. You don't know who you can trust. Of course they won't tell me who made the comment to HR, but really it had to be someone around me that I work with on a daily basis and who knows what I have gone through...so you really don't know who you can trust...at least here in the corporate world!!! It is so crazy that me, being a Christian American woman was so extremely well recepted by everyone I met in Jordan and everyone was so kind and nice and accepting...but bring a Jordanian man to the US and people turn on you...its appalling! And its funny you mention discrimination because that is absolutely what came to my mind when this happened. I have been going over and over in my head if I should, myself, go to HR and make a complaint.

I was once in a similar situation at work and it came to a point where I said... where do MY rights begin?! This is ridiculous.

It is your word against hers and they wrote you up. They should have checked with you, asked what was said and MAYBE gave you a little talk about keeping your voice down or something diplomatic. they could have then talked to the other person and assured her that she had nothing to be scared about.

This is BS and I would go to HR about it and complain and ask for an investigation...bring in the party that you were actually talking to and ask what was said. but, thats how i roll :P Dont allow that write up to remain in your file Amanda. Its not right on so many levels.

Go directly to HR (document EVERYTHING you do say w/ them as well). Make sure to ask for a witness to be with you (you are allowed a co-worker or another supervisor/manager other than the manager you have currently). You need to ask for a copy of the write up and then request that you be made aware of your accuser as you feel this is a false discriminatory accusation by a fellow co-worker. If there is justification for what was stated, you want a full investigation with witnesses (get your co-worker you were speaking w/ to back you if you can.). Then file a complaint based on discrimination/retaliation against your boss as well w/ the name of the employee that was allowed to bring her husband to work and you were directed not to right after the last FALSE accusation by a co-worker. Say you not only feel your husband was discriminated against but you feel your manager was retaliating against you for this prior situation which as no basis and was never investigated to your knowledge.

Before leaving that office, make sure to have a time frame for follow up and ask them to let you know the progress of the investigation. State that you would like this dealt this quickly and swiftly so that you can resume your work without stress of this over your head. (follow up with a thank you email (really documenation of the meeting) and state you look forward to hearing back from them with a resolution on this matter.) PRINT out all your emails and take them home! Does your company have a Corporate Legal counsel? If so, I would send them an email and let them know your situation and that you feel in fear for your job and health because of this false accusation without investigation.

If you are going to leave and look for another job...don't stop on this one...keep the investigation going. You can seek legal counsel if you'd like but I would not do a thing until you see how HR handles it...if they don't move on it and seem like they are siding w/ the manager without an investigation...then get your documentation together and seek legal counsel.
