It has been 4 years and I am still waiting for my oath date to come. They keep saying it is still pending Name check.

Can anyone help me with this issue. this is driving me crazy.

Thought the bottom of that interview approval sheet said 120 days maximum, if not can take it to court, but this was last week, not four years ago. What does your interview sheet say?

It has been 4 years and I am still waiting for my oath date to come. They keep saying it is still pending Name check.

Can anyone help me with this issue. this is driving me crazy. My interview sheet also says 120 days, but i have called the Immigration people so many times but they have the same thing to say, pending name check. I have no criminal history, and the last 9 years i have lived in the USA i never even had a traffic ticket so this is how clean my record is. I came to the USA through the DV lottery process which is also a very straight forward process. So I just cant understand what these poeple are doing. I can go to the court but am not sure this would be a wise decision, but am not sure. I even went to the FBI to see if I have any criminal history, and they gave me a letter stating there was no criminal history at all, and I still have that letter with me. I also went to my congresswomen, and she could not do anything also. Looks like all doors are closed for me.

This seems to be an unusual delay. Have you tried the USCIS ombudsman?

Could the name Wiseguy have anything to do with that long name check, did a people search, no Wiseguy's are listed here.

Did come up with an alias of Ken ken Wahl, but thought he was a movie actor.

Yes...

An immigration attorney will be able to help you with filing the complaint and what needs to be done to merit it. Basically, one needs to exhaust all other remedies to get the mandamus action...

lists the details for "Petition for Hearing on Naturalization Application on file". I interpret that as contacting an immigration attorney.

Have a strange feeling the judge will not award the cost of your attorney and the court cost to the USCIS, but did anybody have an experience with this?

From what I read, this mandamus action will reimburse the cost including attorney fee when it's done.

But if USCIS complete the case in the middle, and the action was taken before final court decision,

you have to pay for the cost by yourself.

I hope I don't need this mandamus action. ^^

ok guys I called the immigration people agian today and they say the name check is done, and nothing came out, but they cant make any decsion as the fignerprint has expired, well i am in Canada right now, and will go back early september 08, and see how it goes. If it does not work this time then I think I will consult with a immigration lawyer and try to resolve this issue.
