how else are you going to get back?

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!

One possibility would be to have the green card mailed but that's pretty risky. I'd be more worried about traveling on the AP and having the green card denied while out of the country.

yes--sadly the above has happened and to folks who were very well established in the US in their communities!

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

Personally I would not leave the country until I had my greencard in hand, even with Advance Parole papers.

As Pushbrk stated: What if the GC is denied after their interview? You stated that their application was in review - doesn't mean it's approved yet.

Or, what if the applicant is called for a second interview and is out of the country and misses it? The application will be deemed to be abandoned and you've got a whole world of problems to deal with.

Sorry to sound negative but unless the trip outside the US is absolutely unavoidable I would stay put and wait for the decision.

I also would rather stay put than travel out of the country. Our case has been slow enough and I would rather be overly cautious. At the same time SEVERAL ppl travel on AP while pending AOS and without problem..so really I guess you decide whether you can wait or not. Everyone has varying circumstances.. :)

There's a difference between pending AOS and post-interview travel though. Generally, it's not so risky to do it with a pending AOS, but if there's a decision being made and there's no word on approval or denial that becomes EXTREMELY risky.

There's a difference between pending AOS and post-interview travel though. Generally, it's not so risky to do it with a pending AOS, but if there's a decision being made and there's no word on approval or denial that becomes EXTREMELY risky.

I completely agree Heliosphan.

The fact that the interview has been held and still no decision has been given makes leaving the country a VERY risky decision

I agree! We waited until her greencard arrived. We wouldn't even dare leave the country on AP. Too risky!!!
