Not to frighten you but - are you aware that adjusting this way has no right to appeal? Do you have evidence that you intended to return to your country of origin if it comes up?

Real scary question. But i have been living in the US for the past 7yrs, I married my husband after living together for 3yrs, i have a 4yr old son who is a citizen. If they send me back...damn. I guess i will go if i don't have a choice.

If I were in that position - I would be heading straight to an AILA attorney to ensure all my bases are covered.

You should be fine, you don't seem to have immigrant intent since you didn't file for adjustment just after arriving. Nice to see another trini!

I disagree, she may very well be fine (who can say that here based on the very few and mosty convoluted facts) - but when filing AOS has no bearing on if they may see this as fraudlant.

Then good luck to you. Just know that people giving you "advice" here are simply lay people. Even a consultation would be more than wise IMHO.

Just an FYI.. If you were in the country while you were "out of status" left the country and then re-entered at any time you may have triggered a ban.

I'm just mentioning this in case you have traveled in and out of the country in the 7 years you were here since you don't tell us your status for the entire time.
