What kind of "legal" is he trying to become? The J-1 visa is a temporary visa for people who will be participating in an exchange visitor program in the U.S. The "J" visa is for educational and cultural exchange programs, sometimes if acquired through your home university, the J-1 is issued for a summer work program here. Presumably the J-1 visa recipient can be here in the US for as long as is stated on his/her I-94 in the passport...but with the J-1 visa, I'm not sure if that is contingent upon fulfilling the sponsorship requirement....i.e. attending the cultural/educational program for which the visa was issued.

As this is a family immigration web site, you may not encounter too much information on the J-1 visa type, but perhaps someone who has more detailed personal knowledge will come along and give you a better direction on where to look for the info you need.

That makes the visa invalid which makes his status invalid.

Note: Non-immigrant students or exchange visitors who fall out of status for reasons beyond their control may be eligible to apply for a reinstatement of status. The student or exchange visitor must work with the school or program official to determine if reinstatement is an option.

Sounds like he has to work with the school/program he came for. Overstay or unauthorized work can lead to very serious legal problems and even a lifetime ban
