I have been waiting 8 and a half months to be with my wife again and it has been become a very long wait so looked for some help from my local senator. I had told him our story consisting of losing all of our life savings and our house over the issue and for me having to be out of the US for several months just to be with my wife. We are currently having to move to a neighboring country wth my wife because my 6 month visa is going to expire in her home country. We are going to a country neither of us know or speak the language, but atleast we will be together. The senator recently got a email back from VSC and this was their respose to our requests:

A review of our computer system shows that the I-130 petition filed by JEFFREY HATCH on behalf of Petya Hatch was received at this office on 11/14/07 and we are currently processing immediate relative petitions received at this office on 7/30/07.

The I-129F K-3 petition was received on 2/21/08 and we are currently processing these case types received at this office on 12/18/07.

In reading through the attachments there does not appear to be any valid reasons given for consideration of expeidtous handling, as many Americans go through the situation described.

Yes I am sure there are other people on VJ that have gone through this, but should we have to? Is this how Americans should be treated? Other than people dealing with immigration I do not know any american going throuh what me and my wife has.

I just wish that you could receive approval at the soonest. You have waited long enough. It is a miserable feeling that we do no even know how long should we wait for their approval. We cannot do anything but pray... :innocent:

This is very very sad; that not even a Congressman can get any support from USCIS.

It bothers me alot that this reply is the total opposite of what would be expected based on the feedback received from the former USCIS adjudicator that appears in the FAQ section of this forum under the "Questions and answer session with a former USCIS adjudicator" heading.

When he talked about "Congressionals", he mentioned that the policy was to give it a little bit more attention. I am at a loss.

I hope this can be of some help to you... We are also in the same position you are in ( my husband and I have been apart for 10 months and we have a 1 1/2 year old baby)... I called the USCIS requested an expedite processing in the basis of severe financial loss to an individual and medical reasons... I am in Brazil ( I am the beneficiary) my husband is in Miami ( he is the petitioner)... They say they will respond withing 5 business days, but they only wrote to us in 15 days after we called and requested further evidence which then we provided an affidavit from him saying that my pronlonged stay in Brazil would cause him (the american citizen) extreme financial loss since he has to support two households one here and himself in the States, we also attached his bank statements showing no money in his account and several high balance credit card statements... As for medical, I went into a doctor here and requested a dignose of my stress which he wrote that due to the severe stress of this situation I was dignosed with panic disorder... Well it was enough to get the expedite request approved for both of our petitions (I-129F for the K3 and the I-130 for the Cr-1)... ( This all happened after we got an identical letter to yours from our Bill nelson (FL senator) office)... Hey since they could not help we decided to help ourselves... We actually went further and called the USCIS director at 202-272-8000 ( It was a lot of research done to get this number LOL) and we are still bugging them on a weekly basis ( sometimes twice a week)... Our expedite request was approved on June 15th, 2008 ( I-130 filled on Feb 2007 and I-129F filled on March 08)... They seem to be working on both of our cases now since when I check the status on line it has been showing a touch almost every other day... I hope they get to answer it all soon, until then I will keep calling everyone... That is what our hard earned tax dollars are for... No one is getting free service here and since we are paying for it you better demand a better service... It is unhuman to put people through so much sufferement like they do with their snail pace... I wrote about this to Michael Ayetes since he is the one responsible for this turtles he calls staff...

I would encourage all of you to write to him... PLEASE WE NEED TO LET THEM KNOW IT IS NOT ACEPTABLE, IT IS NOT OKAY, AND THEY ARE NOT DOING US FAVORS... IT IS THEIR JOB AND WE PAY HIGHLY FOR IT...

( Just for clarification I say we because even though I am in Brazil for the past year I grew up in the States and always paid my taxes for 15 years... I never stayed there one sole day illegally and had to leave not to stay one day over my allowed period...)

I already know the officers at the USCIS director s office by name, they call me with updates... and you bet on Monday morning my husband and I ( since we always call three-way so they can speak with the petioner and I can put the pressure on them)... will be giving them a wake up call...

The senator of my state has been of no help, EVER... I am very disapointed at them...

If what you've experienced isn't financial hardship, I don't know what is.

Unfortunately, you should have contacted them prior to losing your house, including the dunning notices from your mortgage holder. I could see them saying, "what's done is done". :(

Im sorry for your situation.

Is there anything that the Bulgarian government could do to extend your visa stay?

This way you would not have to leave Bulgaria, since that would cause even more hardship for the both of you.

Maybe you have already tried the above suggestion.

This came to mind when i was reading your post.

Just remember that your love is worth this fight.

How is it that Angelina Jolie gets her little asian kids over here (US) in the blink of an eye.. but us poor folk wait months and months for IMMEDIATE relatives... does that term not mean #### to these senators and congressmen? What i'm doing is i'm photcopying my ballot (i vote absentee) of me voting against the the politicians that didnt help me and then sending it to them.. saying thanks for helping a poor natural born US citizen in need.

Sounds like an Idea

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!
