My fiance received her Visa back in May of this year. Right now, she's still in Vietnam due to her mother's health. The visa expired on October. Although, I wanted my fiance to be here with me right now, but due to circumstances, I wouldn't want my fiance leaving her mom like that. My question is that possible to extend the Visa? Anybody done it before? I emailed the consulate but I have not hear anything from them. Thanks for reading.

I think your fiancee should go to USA in time, before her visa expired. When she get the green card, she can come back in VN to take care of her mother.

The general experience is: When you got a visa from HCMC, leave VN as soon as possible.

I think renew K-1 visa maybe lead to be revoke the visa. Your relationship could be suspect. CO could thought that she doesn't like being with you in USA than being with her mother in VN.

You're right about she should leave now. Why take chances after that much of worries and uncertainties?

Just pay attention to this: she won't get a green card immediately upon entry. Since she's on K1 visa, she must apply for adjustment of status after the wedding and then wait some more (2 years at least) to apply for a green card.

According to the HCMC Consulate;" Please note that although a K-1 visa petition is valid for a period of four months, a consular officer can revalidate the petition provided the officer concludes that the American citizen sponsor and the applicant remain legally free to marry and that they continue to intend to marry each other within three months of the alien’s admission into the U.S."

So it is possible. They know that sometimes things don't work out as planned, people get sick, etc. Don't worry sometimes the Consulate is slow answering emails. I had the same problem with some of emails I sent to them. Some were answered within the 7 days they say it takes, others took a couple of weeks. They did always answer them. It's important to get the Consulate onboard as soon as possible so they understand about your fiancee's mother. Once they understand that then it shouldn't be a problem.

Good Luck and we hope her mother gets better soon.
