Hi,

I had a question regarding the I-864. I moved states beginning this year and unfortunately suffered an injury (herniated my back) and haven't been able to work since January because of it. I'm now at the point where it is a lot better and have begun looking for work. Our file is at NVC now and was wondering if not having worked for this time will affect us. I will be using my sister as a co sponsor since I did not make enough last year (student) to make it over the required ammount.

So, if I have a co sponsor who makes well above the required ammount and last year tax return for me shows I worked will it pose any trouble or problems in the interview?

If you have the joint sponsor that meets the requirements on their own, then your income for this year will not be a problem. You will still have to provide an I-864 yourself along with a 2007 return. If you did not file, I would highly suggest icluding an explanation stating why you were not required to file.

"The use of a joint sponsor does not eliminate the requirement that there be a signed Form I-864 from the petitioner with his or her most recent Federal tax return (or proof that there was no obligation to file). The petitioner, as well as the joint sponsor, has full financial responsibility for immigrant(s) they sponsor."

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you don't have enough income to surpass the 125% Poverty Guidelines, then you need a joint sponsor (co-sponsor).

As long as the joint sponsor makes more than the said 125% Poverty Guidelines, you will have NO PROBLEMS!!!

Just fill your I-864, get the documented proofs; also, the joint sponsor will do the same.

If you write a letter, be sure to have it notarized. If you didn't file 2007 taxes that is a must. When I talked to the visa information service (DOS) that's what they said to do. My son didn't file in 2007 because he was finishing college and living abroad, but had adequate US income the first half of 2008. We also included things such as his past tax transcripts, his cumulative SS earnings statement and even his college transcript and a letter of recommendation for employment to prove that he has good prospects for his career. This was all just for an I-134.

I think the person reviewing your AOS would appreciate a concise, crystal clear explanation of your situation.

What country?

Someone from the Philippines was just denied using a co sponsor at the interview. Had to try and qualify on their own.

Did you qualify with your 2007 tax return?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

no it wont be a problem as long ur joint sponsor will pass the 125% poverty line. both of you need to file up I-864 or I-864A. 1-864- if u dont live in the same house hold... I-864A contract between house hold. means u guyz live in the same household. i hope it helps goodluck
