Hi

Are there any K1 people out there who moved to New York and applied for their New York State driving permit before their Green Card arrived?

We are getting married on August 23rd but ideally I want to get the driving permit ASAP to use as ID. Sometimes (especially outside of NYC) I get problems presenting my UK drivers license and don't want to be carrying my passport around!

I read somewhere that you need to show your Green Card but looking at the NY DMV site is seems to be OK to show my passport with the I-94?

Any advice from those who have been through this process in New York State would be gratefully received!

You can try it but I've read from different people living in NY that they won't do it unless you have either your EAD in hand or green card.

Sometimes the people at the dmv dont know whats going on LOL, things change so fast. I think you can apply for your permit with the passport/ead/I-94.But when that expires, then you will have to apply all over again , you wont have to take the written test again, but you will have to pay a small fee and fill out the application again for an amended permit/dl whichever at that time applies to you..........$10..... . good luck!

Permanent Resident card received 11/05/07 (dated 10/31/07)! THank u LorD!

Will file for 10 year GC End of July/Early August 2009!

VSC received the I-751 Packet 09/11/09 About 12 pm Local time

Check was cashed as of Sept 16th 2009

NOA Received 09/19/09 dated 09/14/09

I-797 Appointment Notice received 10/01/09 dated 09/25/09 (Biometrics)

Got they 10 year GC approval letter in the mail dated 01/08/10! yehey!

10 GREENCARD RECEIVED 01/20/10

Citizenship.......maybe............or maybe stay a permanent resident .......................

You can get one before the EAD or GC, as long as ALL your documents in the same last name. This can be a problem for women who use their married name on their SS card. You need your passport (to prove date of birth), SS card, marriage certificate, and a couple other things to prove your name (mail, paystub, insurance card, credit card/atm card, etc).

My wife had her passport in her maiden name and SS card in her married name, so they didn't match, and she was told to either change the name on the passport or wait for a GC/EAD. So we have to wait for her EAD (in married name) since Costa Rica doesn't allow name changes on government documents.

Hi Martin&Nat,

I don't know how it works with the K1 situation, but I do know that you do need at least an SSN before applying for an NYS ldriver's icense, as in all cases, they won't grant you one unless you have such. There was a delay for me getting an SSN, so that delayed me in getting my NYS driver's license. But once I got it, about 8 weeks later, all I had to show the DMV was my actual green card, my SSN card, marriage certificate, and Canadian driver's license (I was transfering my license over), and I got my NYS driver's license in the mail within 1 week. Likewise, I understand too, as it was a pain in the neck before I got my green card and NYS license, since I had to carry my passport and Canadian license (which both had my former maiden name, yuck) around too...

Good luck with your immigration situation and that you'll get your license soon.
