TOO LATE OR NOT TO FILE TAXES

Anybody can help me if its too late to file taxes for 2007 (although my hubby keep telling me he has extension till' October 2008)????????????? We are going to submit our papers,but lacking Income taxes. So i want to clarify only if we can still apply or its too late and better wait again next year filing....so frustrated...Need some reply pls. Thnxs.

From what I understand it is never "too late". What could happen is to be subject to penalties and have to pay. BUT then again, this is the first year I have filed taxes in the US.

File away.

Do u think so? but my husband didnt file his business & personal for 3yrs now :blink: :blink: , and when i am asking him, he would then say that he has an extension....i dont now any legalities here in US..thats why i need more info.

its never too late unless you owe the gov't and you did not file for an extension. Go ahead and file your 2007 :thumbs:

Not too late but the longer you wait the worse it will be. Even if you get an extensions your taxes are due by the April 15th of each year.

How did you get your visa to come here....in most cases, copies of filed tax returns (as proof of income) are necessary for the visa?

You need proof of financial sponsorship for your AOS papers...and if your husband hasn't filed personal or business income tax returns for the last 3 years, you may have some difficulty with this issue. AOS will not be granted until the financial sponsorship issue is sorted out. Why isn't your husband filing his tax returns? It is true that you can file an extension, but that is only good for 6 months. I'm not sure, but I don't think if you've already been granted an extension that they grant any subsequent ones...you must file at the time your extension expries. You may need some professional help, like an accountant or someone to prepare the taxes, and they should be filed ASAP.

As long as he got the extension, there will be no problems. Except if he owes money there will be penalties. Which is the only reason that I could think of filing an extension, you sure would not do it if you were getting money back. But he needs to get them in for the AOS process.

I filed an extension and we are due a refund. My reason was the stimulus rebate. To receive the stimulus you need SSN's. To get a SSN, a K-3 needs EAD. We filed AOS and EAD late last month. Should have EAD by mid-Sept, SSN by end of Sept, and file taxes by Oct 15th (when extension ends). By waiting to file taxes, the stimulus rebate for us is $2,100. If I had filed taxes prior to April 15th, the rebate would have been $0 (although I could have filed an amended return once the SSN's were obtained).

Originally, we were going to wait until Aug/Sept to file AOS so that Rin's GC would be 10yr instead of 2 yr (2nd wedding anniversary is in October). Now we are probably the only one's hoping that our June AOS application does not get transferred to CSC and approved without an interview!

Now not filing taxes for three years? Yikes!

I came here thru K1- Visa of course, and we got married before I-94 ends. During our Interview, the consul are more focused on our relationship, and yes he declared extension too for his taxes. We have an accountant for his business & personal taxes, he still working it out still..and his due is in October 2008. But anyway guys, thnxs for all the replies, i appreciated it very much . If you do have an extension it is a six month extension. So you have until Oct to file. Don't wait until next year.

If you do have an extension it is a six month extension. So you have until Oct to file. Don't wait until next year.

For individuals it is a 4 month automatic extention until AUGUST 15... If people need more time they need tio request a second extention for two add'l months. The caveat is that the second extention is NOT automatic and the taxpayer needs to provide a reason as to why.

A person cannot receive an extention of time to cover three years of returns. Also, if any of the previous years returns end up in a deficit (and thus classified as "failure to file") then all subsequent extentions for years after are void and any return that is in a deficit situation is subject to in addition to standard underpayment penalties but also failure to file penalties (quite onerous BTW). If you are in a refund situation then things are so much better when trying to clear up "sins of the past".

The taxman is not someone to play games with.
