I have a different slant on the topic..... american citizen(male) and UK citizen(female) get married entering via k1 - have a child say in 1 1/2 - 2 years. Say the AOS hasnt been approved by the time the child is born am i right in thinking:

1. The child is automatically american citizen because the father is and no other paperwork is required for the child?

2. What if the mother (UKC) wants the child to have UK citizenship as well as american citizenship what must be done for that?? I presume have the child's birth registered in the UK, is this possible via online or is that a trip to the UK?

3. Mother applies for american citizenship and has duel citizenship and the child also has dual citizenship is that possible?

Just forward planning... and advice, suggestions, comments welcome..

Lina,

1-the child is automagically a USC for being born in the US. If born out of the US, still a USC via the father.

2-the child is automagically a UKC for being born to you. Register the arrival with the UK Consulate and apply for a UK passport.

3-yes, that's possible. My mom did it! :)

Where is the child born? Anywhere in the world, the child is automatically a US Citizen if he/she has a US Citizen parent who spent enough time residing in the US. However, if the child wants to PROVE that citizenship in order to gain any benefits of the citizenship (such as the ability to travel to the US, to get a US Passport, etc.), then some paperwork is required if the child is born outside the US. File a "Consular report of birth abroad" at the nearest US consulate. They'll probably require proof of parentage and proof of the parent's citizenship and residency.

If the child is born in the US, the child is also automatically a US Citizen, and the birth certificate showing the US birthplace is all that's required to prove citizenship. Per the 14th amendment to the US Constitution, the child's citizenship doesn't even depend on having a US Citizen parent.

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.
