Ok I think the answer to this question is no but I want some other input and haven't found the answer browsing USCIS. My husband and I are having a child in the next year. We are in the process of filing AOS for him, and hopefully he'll have his green card by the time the baby comes. I know that the child automatically gains citizenship from being born here, but does he have a right to citizenship faster? We're only asking the question from hearing stories in the past but I tend to think those people were not granted citizenship but perhaps residency? Any thoughs?

May 11 '09 - Case Approved 10 yr card in the mail

June - 10 yr card recieved

Feb. 19, 2010 - N-400 Application sent to Phoenix Lockbox

April 3, 2010 - Biometrics

May 17,2010 - Citizenship Test - Minneapolis, MN

July 16, 2010- Retest (writing portion)

October 13, 2010 - Oath Ceremony

I don't think so. Your husband will still have to go through the normal AOS process.

Amera his citizenship will not go any faster with him having a child in the USA.

He will have to do the AOS process just like everyone else and then after a few years he can apply for ciitizenship.

Your husband already qualifies for the fastest (adult) track to citizenship via his marriage to you. He gets a waiver of the '5 years resident' condition and has it pared down to 3 years. He can apply 90 days before he is eligible.

So...what....breeding is suppose to bring on the rewards of citizenship? Is that how it's supposed to work? Daaaammmn..bad enough he gets a tax deduction for it.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

Wow- a simple question trying to clarify something that is extremely important: namely, being able to remain near your child regardless of anything else- turns into an exercise in nastiness. Why am I not surprised.

That was not the question.

The child would probably be entitled to the citizenship of the father if it is that big an issue.

I have a different slant on the topic..... american citizen(male) and UK citizen(female) get married entering via k1 - have a child say in 1 1/2 - 2 years. Say the AOS hasnt been approved by the time the child is born am i right in thinking:

1. The child is automatically american citizen because the father is and no other paperwork is required for the child?

2. What if the mother (UKC) wants the child to have UK citizenship as well as american citizenship what must be done for that?? I presume have the child's birth registered in the UK, is this possible via online or is that a trip to the UK?

3. Mother applies for american citizenship and has duel citizenship and the child also has dual citizenship is that possible?
