AP application - *head explodes*

Okay. K-1 visa holder. Applying for AOS. Wish to apply for AP at the same time. Don't have any specific journey planned right now outside the US, but wish to have AP coverage if and when I do.

What do I fill out, what other documentation do I need, can I even do this? My head is bleeding right now.

Fill out the I-131, and file concurrently with 485. You will need 2 pics, passport copies, and I94 copy.

Lots of people fill it out without any specific trips planned. Especially now that the fee is included in the AOS.

1) If the guide was helpful enough, we wouldn't have posted

2) If she can fill out AP without any specific dates in mind, how do we know she's covered? She won't get any document that says "You can travel on XX date" because we don't have XX date filled in yet

3) Where exactly does it state that AP (/ EAD) are included in the filing fee when filed concurrently with AOS? I know we have both seen it peppered about the site, but neither of us can recall seeing it on any 'official' paperwork.

The document(s) she will receive will have an expiration date (see pic in gallery). Looks like it is valid for a year.

You may file the I-131 for Advance Parole or for a Refugee Travel Document concurrently with your I-485, or you may submit the I-131 for Advance Parole or a Refugee Travel Document at a later date. If you file Form I-131 for advance parole or a refugee travel document separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence that you filed and paid the fee for the Form I-485 required on or after July 30, 2007."

OK, slow down and take a breath... I understand what happens when you hit the paperwork wall! In answer to your questions:

1) The guides, combined with the instructions that come with the form, actually do have good information (but I know it's a lot to go through)

2) You don't need to put specific dates on the I-131; you can just put "To be decided" for the dates, and in the section where you need to qualify your reasons, just put the truth - that you want to have the freedom to travel before the green card comes, e.g. to visit family, etc.

3) If you look at the I-485 instructions, at the bottom of page 7 it explains about the concurrent filing of all three forms.

This also is part of the EAD instructions:

"NOTE: If you filed a Form I-485, Application to Register

Permanent Residence or Adjust Status, as of July 30, 2007, no

fee is required to also file a request for employment

authorization on Form I-765. You may file the I-765

concurrently with your I-485, or you may submit the I-765 at a

later date. If you file Form I-765 separately, you must also

submit a copy of your Form I-797C, Notice of Action, receipt

as evidence of the filing of an I-485 as of July 30, 2007."

Also, regarding the AP, if it gets to be within 120 days of the AP's expiration date, you can refile I-131 to receive another one. This would only be necessary if it took more than a year to get a GC. You would have to submit a copy of your NOA from the I-485 to show AOS is still pending and the second AP filing would also be free of charge.
