i am from india and got married to a us citizen in january 2008. my husband filed for k3 visa in march 2008. under our immigration lawyers guidance we filed both I-130 and I-129 forms at the same time. on 11march 2008 we received NOA fro 130 form but none for 129. is it that we have to reapply. its almost 5 months now and we have not heard anything yet. after reading the posts here i am wondering if the lawyer misled us. is there some way to confirm if they have our 129form. if they dont have our form what should be my next step.

i was hoping to hear a positive response next month but now i feel i am lost.

please answer!!!!!!!!!!!

If both an I-130 and an I-129F were filed, you would have two receipt numbers. Do you have two different receipt numbers from USCIS?

If an I-129F was never filed (or even if it has been but has not been approved), you can pursue the CR-1 visa. The I-130 should have reached the NVC by now. NVC should have notified either your husband or lawyer (by sending an IV bill). Check the guides for CR-1/IR-1 for more details as to what is next for this path.

OK, I tried to edit my post, but it wouldn't let me save it. Disregard my post as I misread it as the I-130 being approved, not just received.

Regarding the I-129F, has your husband tried calling USCIS and finding out if they have the I-129F (it should be linked within their system to the I-130, I would think).

I never got the NOA for my I-129F when it was filed by my lawyer. I got one for the I-130. From reading here, it looks like this happens now and then. If you are using a lawyer, I would contact him and see if he received one. If not, did you pay with a check? If you did apparently the put the receipt number on the canceled check. Otherwise call them and ask. I know I would want to know they received it.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Hey do not worry, I also filed for my wife case in Mumbia India. And if you filed with lawyer then the lawyer is going to be the only one recieving the I-129F reciepts so don't panic...check with your lawyers.

Where in Mumbai are you from?????

The only thing you have to do right now is tell him to call the Sevice Center and say that you haven't received the NOA for youR 129F. On their site it says to call then if you have sent this form for more than 30 days and haven't got the NOA.

I-130 {CR-1] is a much better visa than the K3. I'd stick withn the CR-1.
