RFE for I485 and other documents

Hi,

I just received an email notice that I was being sent a letter with a Request for Initial Evidence for our I485. This is of course very disappointing. I don't know yet what the problem was with our application but my question is how long this whole process might hold up our 765 application? My husband is quite anxious to work and we assumed we would have the EAD by now.

I'd love to hear some advice from other people who got an RFE and how much it held up the process for our other documents.

Yes they hold up all petitions that are related to the I-485, so yes, this will hold up the EAD petition.

RFE will tell you what was lacking. Did you include an I-693 Vaccination record?

Yes, I included I693 Vac record with signature from Civil Surgeon doctor. I know a lot of people have problems with the I864 which is a confusing document. Since I have a co-sponsor maybe the problem had to do with the supporting documentation.

Perhaps that is it, Joint sponsor needs to provide similar financial information as the primary sponsor, that is I-864 and (IRS return, and perhaps pay stubs, and employer letter) IRS return can be simple IRS transcript.

This is speculation you need to see what the RFE is asking for.

We had two RFE's, but I don't think they held up the EAD. The delay came after the second RFE was submitted. Timeline as follows:

July 24, 2007 - I-485, I-130, I-765 all filed via attorney

Aug 27, 2007 - first RFE for copy of husband's tax extension form #4868

Aug 28, 2007 - NOA for all three applications

Sep 7, 2007 - Biometrics appt

Sep 17, 2007 - Response to first RFE sent via attorney

Oct 12, 2007 - EAD approval

Oct 20, 2007 - EAD card arrives

Nov 15,2007 - second RFE for copy of my old passport, which had expired and been replaced

Dec 4, 2007 - response to second RFE sent via attorney

Mar 13, 2008 - request for congressional help sent via attorney

Apr 29, 2008 - appointment letter for AOS interview received

Jun 16, 2008 - AOS interview - APPROVED!

July 5, 2008 - Green Card arrives

I just received an RFE as well by email, i am waiting on the actual paper. From what I understand yes it does put the I485 and everything with it on hold.

I understand how you might feel .We received a letter via email requesting RFE.

However I'm glad to know that our case was reviewed but just missing the doc's they ask for.

From what I gather from the letter make sure you (submit ALL the information requested at one time).It slows things up,

but it's all about getting GOOD) results at the end.
