K3, I130 and I129F, confuesd

Timeline
The K3 guide seems to suggest that one can only file I130 and can go CR-1 route. But on regular K3, need to file I130 then I129F.

And I see everyone filed I130 and I129F, why is that?

Probably because it is free to file I-129F, and then we choose whichever route we want to go. I chose the route of the first petition that would make it to the embassy.

Probably because it is free to file I-129F, and then we choose whichever route we want to go. I chose the route of the first petition that would make it to the embassy.

Because use to be filing the I-129F for a K3 USE to be quicker, which is not the case anymore, especially if it goes to VSC.

You are correct, I-130 by it self is CR-1 or IR-1 IMMIGRANT visa.

Filing I-129F after getting I-130 NOA1 letter starts a K-3 process.

NOTE for most consulates CR-1 is only taking slightly longer to process.

CR-1 is a true immigrant visa and results in a GREEN-CARD upon entry, this allows WORK, applying for a SSN and even applying for a driver's license.

K-3 is a NON-Immigrant visa, and is NOT work auth. K-3 needs to adjust status ($1010) and cannot WORK, get SSN or apply for a driver's license until they get green-card or EAD. EAD can take 90 days or longer to get.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

Fees not in the figure are Medical, and Vaccinations.

As you can see the CR-1 is a cheaper way to go plus a MUCH better way if you consider K3s can't get their SSN until they adjust status. AOS isn't guaranteed also. Some people are still waiting a year after applying for such. There is also a SMALL chance of being deported. No SSN! No work which may end up costing the couple a LOT more in the long run.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

EXACTLY!!! That is why when we re-file in a few weeks, we are going CR-1 way instead of K3. Good Luck everybody. Im off to Paris sooner then planned.
