Is AOS really this complicated??

Even if she plans to work, you could file for EAD ($340) now and wait to file AOS. It would still cost $1,010 for AOS, but the cost of lifting conditions is $545, so it would save you $205 in the long run.

Would this mean we could also get a 10yr GC in lifting conditions??

A K3 holder can still pursue the CR1? Everyone on the CR1 Forum seems to say that isn't an option. Has anyone actually done this?

I can vouch...this happens at the dominican consulate ALL day, every day. You just have to email or communicate to the consulate that you want your K3 interview converted to a CR1/IR1 interview...

#1 thing though to make it possible: you CR1 must be completed (at the NVC) at least 2 weeks before the interview.

This practice of converting the K3 interview to a CR1 interview usually happens at consulates with a backlog of interviews such as Dominican Republic (currently 75-90 days of waiting AFTER the NVC is complete)

Not the interview changed, this thread is about K3 visa holders who want to go back for a 2nd interview to get the CR1.

If you file AOS and receive your GC prior to your 2nd anniversary, you will receive conditional permanent residence (and be issued a 2 yr GC). If the GC is issued after your 2nd wedding anniverary, you should receive permanent residence (not conditional) and be issued a 10yr GC. If you have a 2 yr GC and you file to lift conditions, you will be issued a 10 yr GC upon approval.
