I got a Rejection Notice on I-485 saying:

"INVALID PART 2 APPLICATION TYPE OTHER BASIS AOF ELIGIBILITY"

I check the last box:other basis of eligibility, and I explain that I camed here on a J1 visa, I got married and now I'm applying for AOS

what did I did wrong, should I check other checkbox?

6/26/2005 arrived to us with J1

9/09/2005 got married

05/03/2006 send I-485,I-765 and I-130 to Chicago

05/12/2006 received Rejection Notice on I-130

05/15/2006 received Rejection Notice on I-485 and I-765

05/20/2006 send papers again

05/22/2006 USCIS received the forms(1)

06/01/2006 NOA1 for all 3 of them(11)

06/05/2006 TOUCHED(15)

06/15/2006 letter with biometrics appointment(25)

06/17/2006 I-130 and I-765 TOUCHED(27)

Anca, as other VJers have been telling you, you should have checked box a) on both I-130 and I-485 -- you are eligible to adjust status on the basis of a petition that, if approved, will make an immigrant visa number immediately available to you. What I suggest you do is check the correct box and re-send your application (I-485 and I-130 will all supporting documents in the same package).

Also, I think it would be easier for everyone to follow your story if you don't keep opening new posts -- please keep your questions to one single thread, and people will be better able to help you.

It sounds improbable that the USCIS would reject an application just cause you checked the incorrect box on the form. From what I've read they usually correct common mistakes.

There is some kind of a two-year residency requirement for a J-1 visa. To apply for AOS you need to get a waiver for that, do you have that already?

Maybe, if they know with certainty that a mistake has been made, which they may not know.

2 year rule does not apply in my case

I change the checkbox(from d to a) and I going to send the papers again

hopefully this time is going to be fine

What a pain huh? When we filled out our forms, on the I-485 form, on Part 2 Application type, we checked J: Other basis of eligibility and explained that it is based on marriage to a US citizen (since he did not have an A # yet) and our journey went smoothly, did not get any rejection letter because we checked the wrong box....

Did the USCIS also return the I-130 petition?

Suspecting that they did not, don't forget to include a copy of the I-130 Receipt Notice with the I-485 or you may find it being returned again.

That would be h, not j ? That error in posting aside, it was clear in your situation that you should have checked c, not h, and so the USCIS could confidently correct your error. It was not so clear in anca's situation, in her case it simply appeared that she had applied for adjustment with no basis for the application.

Well first my I-130 was rejected because I sent I-130 and I-485 in different envelopes

then my I-485 was rejected because the part 2 because it was "invalid"

but I did the same as Wellsdr did:check the box h and explain that I'm applying for AOS based on marriage.

everybody tells me that I should check a)

I'm going to send the papers again on saturday and hopefully I don't receive another rejection notice,if I do I'm going to be very upsad :(

I don't see why anybody would find it insulting for some folks to exchange a few words in their native language. This post smells of racism!!! As far as I know there are no English requirements on VisaJourney.
