i'm just confused, we applied k3/k4 visa. i understand that i have to bring my daughter (from previous marriage) during the medical and interview, but i'm confused if i have to bring my son (with my us husband now), we applied him as a US citizen born abroad last week the consul said we'll wait 6-8 weeks for his us citizen passport.

my questions:

1. should i bring my us citizen son to manila for medical and interview or he is safe and can use his us passport when we travel to us? (he also have philippine passport)

2. do i need to pay DS-156 visa application for my daughter too? or she already part of mine?

3. Both of our ircr1 and k3/k4 were approve, do i need to File an AOS? what if we'll pursue the spousal visa do we still have time now that we're already schedule for k3/k4 interview two weeks from now?

4. my husband received an email of undeliverable letter from USCIS since he move here in philippines before he got the NOA2, can he call us embassy in manila that he move to phils. so that all papers will be addressed here?

5. just today, again.. just today he received a job offer from argentina, if ever our visa get's approved is it a problem if we live in US and my american husband will work in argentina?

i really need your help and opinion!

thanks,

viena

NO US CITIZEN CAN ENTER ON HIS/HER PASSPORT NO VISA REQUIRED

2. do i need to pay DS-156 visa application for my daughter too? or she already part of mine?

YES YOU NEED TO PAY APPLICATION FEES FOR ALL APPLICANTS

3. Both of our ircr1 and k3/k4 were approve, do i need to File an AOS? what if we'll pursue the spousal visa do we still have time now that we're already schedule for k3/k4 interview two weeks from now?

YOU WILL FILE AOS ONLY IF YOU ENTER ON K3 VISA IF YOU WAIT AND DO CR1 YOU WILL NOT NEED AOS SINCE YOU WILL RECIEVE YOUR GC AFTER YOU ENTER US.

4. my husband received an email of undeliverable letter from USCIS since he move here in philippines before he got the NOA2, can he call us embassy in manila that he move to phils. so that all papers will be addressed here?

HE HAS TO CALL NVC AND DO AN ADDRESS CHANGE

5. just today, again.. just today he received a job offer from argentina, if ever our visa get's approved is it a problem if we live in US and my american husband will work in argentina?

YOUR HUSBAN CAN WORK ANYWHERE HE WANTS AND YOU CAN LIVE IN US THAT SHOULD NOT BE A PROBLEM

i really need your help and opinion!

Please forgive me for using this teaching opportunity as an example of why it is so important to use the correct terminology. You have not applied for a visa yet. (You will when you provide an actual visa application and pay a visa fee.) What originally occured is the USC filed a "Petition" which when approved, gave the foreign spouse and any qualifying step-children the privilege of applying for visas. So yes, each intending immigrant needs a visa application and medical of their own.

US Citizens don't need visas or anything that goes with them, like visa applications, medical examinations or interviews, in order to enter the US. They just need a US passport.

We get people here all the time who think their USC spouse or fiance(e) applied for a visa in their behalf. As such they face the same confusion you demonstrate here, because they've repeatedly heard the initial filing referred to as a visa application when it's not.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous
