Foster mother needs a co-sponsor?

Thanks for the info. I have 4 living here. If I had 5 or more it would be considered a group home and the rules and conditions of my home would be dramatically changed. (sprinklers,staff) So I guess I dont qualify for income. So I guess in a way Im poor haha. Maybe I should get back at them and apply for food stamps and welfare, what the hell everbody else does, jk. If I did that we would see how fast my income was counted huh? Ya know Ill find somebody even if I have to pay them lol. oh ya im poverty. I really am grateful though because he made it past immigration in Morocco. The guy didnt even look at all our proof. I dotted my I's and crossed my t's on the paperwork so to my knowledge it was PERFECT. I guess if they really looked at it and knew laws about this my husband wouldnt have made it out of Morocco. Well its been 21/2 years now we have been married. I dont know what would happen if I didnt find a sponser by next month. I dont think now they can deport him what my real worry is I will have to start the paperwork all over again now we are talking thousands again :angry: If he is denied and we cant get a sponser (vise versa) does anyone know what will happen?

Does your husband have taxable income? His income can count so long as it will continue after AOS. From the I-864 instructions:

"What If I Cannot Meet the Income Requirements?

If your income alone is not sufficient to meet the requirement for your household size, the intending immigrant will be ineligible for an immigrant visa or adjustment of status, unless the requirement can be met using any combination of the following:

Income from any relatives or dependents living in your household or dependents listed on your most recent Federal tax return who signed a Form I-864A;

Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is your spouse, his or her income can be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident."

Is this his initial adjustment of status, or are you in removal of conditions? I'm not sure from your posts. You really should do the best to find a co-sponsor....as you do not want to be denied due to your non-reply to an RFE.

What is your husband's status now? Who sponsored him for the K-1? Do either of you work at all?

No this is initial. We filed in 2006 for adjustment of status and each time we got a letter for more info we sent iot. Just the last time was in aug of 2007 I sent all the proof for income and havent hear anything since then till now. Now they are giving us one month. I see on the post it says only a sponser living in your household???? Are they serious???

Can someone tell me what will happen to my husband if I dont find a sponser. We have been married for 2 1/2 years here in america and filed for aos but they cant use my income for support and I have to find a sponser in one month. If I cant what will happen?

I am sooo mad. It has been 2 years since we file for adjustment of status and have been calling and calling. We got a letter for proof if income i-485 but I am a foster mother and taxes are not taken out of my pay because its like the state taxing itself. I make more then 50 thousand a year and sent all the proof. I own a house worth over 300 3 cars bank ext. I sent immigration all this proof and deeds and bank statements, letters from my jobs(agencys) stating how much I make. They send me 2 times asking for proof saying I dont meet the income lines?????Come to find out they dont consider the money I make as income. I dont know why. Any way now they are saying I need a co-sponser. My husband has been here almost 3 years now. I cannot believe this. I have asked some of my family and they are like oh i cant do that that means im responsible financially for 5 years. I am ready to screeeeaaaaam!!!!! I can not believe this. After a year from the last time I sent in proof they send me a letter saying I have a month to get a sponser. I dont know what to do. I saw if i had 3x the povverty level in assets they could use that but i sent all that and still no? i dont understand. someone to do . I am disowning my family after this. Please someone give me advise.

Another evidence of income is a letter on bank stationary from one of its officials, saying how much your current balance is, and how much you have deposited in the last 12 months. But I agree from this distance, that you are functioning like a small business and should incorporate. Pay yourself a salary from the small business income, along with Social Security taxes. A good lawyer will help you fix it up, but not in 30 days...lol.

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

Your husband will have an order of deportation once you get denied for not being able to prove that you or a co-sponsor could support him financially.

So what your saying is even if we are married for 2 1/2 years they can still deport him? I thought there was a certain amount of time they cant. Like some kind of cut off. To me when I sent all my info before he came to this country with all the evidence shouldnt they have denied it then? Why wait till now? I said that to immigration. I said Why was it ok for the evidence and all my letters from employment and bank statements and deeds to my house why was he allowed to come into this country then but now its not? I dont see how they can deport him after almost 3 years of being here and 2/1/2 years of marriage. Thats insane to me.
